I~~SOII.I~I®1~1 N®. 91-260 ~.C.~. 1 2 3 ADOPTING A MITIGATED NEGATIVE DECLARATION PURSUANT TO CEQA 4 AND LOCAL GUIDELINES FOR THE AMENDMENT OF THE GENERAL PLAN 5 LAND USE ELEMENT MAP TO INCLUDE A 33 ACRE PARCEL WITHIN THE 6 URBAN LIMIT LINE AND DESIGNATE THE LAND USE AS URBAN of the City of Petaluma, California 7 SEPARATOR (A.P. No. 136-070-19) 8 9 WHEREAS, the City Council will consider an amendment to the General Plan Land Use 10 Element Map to incorporate a 33 acre parcel within the Urban Limit Line with a land use 11 designation as Urban Separator; and, 12 13 WHEREAS, staff prepared an Initial Study of potential environmental effects pursuant to 14 the California Environmental Quality Act (CEQA) and recommended certain conditions 15 that would reduce the potential effects to a level of insignificance; and, 16 17 WHEREAS, the City Planning Commission reviewed the Initial Study on the proposed 18 amendment and held a public hearing on July 23rd, 1991 and recommended to the City 19 Council the adoption of a mitigated negative declaration in their report filed with the City 20 Clerk as set forth in the minutes of the meeting; and, 21 22 WHEREAS, the City Council held a public hearing on August 19th, 1991 to consider the 23 proposed amendment; and 24 25 WHEREAS, the City Council finds based upon the Initial Study and any comments 26 received that there is no substantial evidence that the amendment as conditioned would 27 have a significant effect on the environment; and 28 29 WHEREAS, staff has prepared a mitigation monitoring program in accordance with 30 CEQA and local guidelines that have been incorporated into the project conditions as 31 listed below; 91-260 Res. N.C.S. 7~ µ ~ ~ ... - 1 NOW, THEREFORE, BE IT RESOLVED that the City Council hereby approves a 2 Mitigated Negative Declaration for the amendment to the Urban Limit Line to include the 3 33 acre parcel (AP No. 136-070-19) designated as Urban Separator with the following 4 conditions: 5 1. The extension of utilities and access to the 33 acre parcel shall be limited to mitigate 6 the potential for inducing growth beyond the urban boundary. The City Engineer 7 shall review any subsequent development plans to ensure compliance with this 8 condition. 9 2. An Avigation Easement shall be dedicated to the City of Petaluma and County of 10 Sonoma that specifies height limitations in accordance with Part 77 of Federal 11 Aviation Regulations and enables the airport authorities to remove, mark or light 12 any potential hazard or obstruction. The recorded aigation easement shall be 13 submitted to the City prior to approval of any subsequent development plans. 14 15 16 glfnegdc/jb-6 Under the power and authority conferred upon this Council by the Charter of said City.
