HomeMy WebLinkAboutResolution 91-245 08/19/1991Resolution No. 91-245 N ~.5. of the City of Petaluma, California 1 2 APPROVE GRADING PRIOR TO >F'INAL MAP APPROVAL 3 FOR REDWOOD BUSINESS PARK 3, PHASE 1 4 5 WHEREAS, the developer, G&W Redwood Associates, has requested to grade prior b to approval of the final :rap and improvement plans for said subdivision by the City; 7 and, 8 9 WHEREAS, this Council has determined that this request should be granted on the 10 condition that the Subdivider enter into a written agreement satisfactory to the City 11 Attorney and the City Engineer, guaranteeing that final grading will conform to final 12 map and improvement plans when approved. by the Director of Engineering; and, 13 14 WHEREAS, Subdivider states it is his intention to enter into a Subdivision Agreement 15 upon approval of the final map for same. 16 1. The grading proposed by Subdivision is not a permanent improvement as that 17 term is used in Section 20.36.010 of the Petaluma Municipal Code.; 18 2. Subdivider shall give an agreement in writing guaranteeing compliance with all 19 City codes and ordinances as well as compliance with the requirements for final 20 grading as determined by the Director of Engineering. 21 3. Subdivider shall provide a cash deposit or a surety bond to cover the cost of 22 grading, restoration and erosion control. Amount of deposit or bond, securing 23 performance of this work, shall be satisfactory to City Engineer and City 24 Manager. 25 4. Said agreement shall provide specifically that any and all liability arising out of 26 the work performed by the Subdivider, whether such liability arises from acts or 27 consequences occurring on-site or off-site shall be the sole responsibility of the 28 Subdivider. In no event, shall work be commenced on said grading until an agreement is 2 signed by the Subdivider and the City of Petaluma and all conditions precedent 3 to said work are performed. 4 5 6. The grading and erosion control shall conform to the improvement plans 6 submitted for the grading permit. Prior to grading permit issuance, the 7 developer shall have approval from the appropriate agencies, including, but not 8 limited to, Sonoma County Water Agency, Corps of Engineers, and California 9 Department of Fish & Game. Additionally, a grading permit shall be secured. 10 from the City of Petaluma prior to starting any work. 11 12 7. Subdivider shall agree to perform work in accordance with the City of Petaluma 13 Erosion Control Ordinance and said Erosion Control Plan shall be approved and 14 installed prior to grading. 15 16 8. The City Manager is hereby authorized to execute an agreement on behalf of the 17 City, approved as to form by the City Attorney. 18 19 csred3pl Under the power and authority conferred upon this Council by the Charter of said City.
