HomeMy WebLinkAboutResolution 91-238 08/05/1991I~eSOllltl®rl NO. 91-238 N ~.5. of the City of Petaluma, California 1 2 APPROVE GRADING PRIOR TO FINAL MAP APPROVAL 3 FOR WESTRIDGE 4 SUBDIVISION 4 5 WHEREAS, the developer, Condiotti Enterprises, Inc., has 6 requested to grade prior to approval of the final map and 7 improvement plans for said subdivision by the City; and, 8 9 WHEREAS, this Council has determined that this request 10 should be granted on the condition that the Subdivider enter 11 into a written agreement satisfactory to the City Attorney 12 and the City Engineer, guaranteeing that final grading will 13 conform to final map and improvement. plans when approved by 14 the Director of Engineering; and, 15 16 WHBREA3, Subdivider states it is his intention to enter into 17 a Subdivision Agreement upon approval of the final map for 18 same. 19 20 1. The grading proposed by Subdivision is not a permanent 21 improvement as that term is used in Section 20.36.010 22 of the Petaluma Municipal Code; 23 2. Subdivider shall give an agreement in writing 24 guaranteeing compliance with all City codes and 25 ordinances as well~as compliance with the requirements 26 for final grading as determined by the Director of 27 Engineering. 28 3. Subdivider shall provide a cash deposit or a surety 29 bond to cover the cost of grading, restoration, erosion aes. Said agreement shall provide specifically that any and all liability arising out of the work performed by the Subdivider, whether such liability arises from acts or consequences occurring on-site or off-site shall be the sole responsibility of the Subdivider. In no event, shall work be commenced on said grading until an agreement is signed by the Subdivider and the City of Petaluma and all conditions precedent to said work are performed. The grading, erosion control and construction of the weir structure shall conform to the latest set of improvement plans submitted to the Engineering Department. Prior to issuing any permit's, the developer shall have approval .from the appropriate agencies, including, but not limi ed to, Sonoma County Water Agency, Corps of Engineers, and California Department of Fish &~Game. Subdivider shall agree to perform work in accordance 3 with the City of Petaluma Erosion Control Ordinance and 4 said Erosion Control Plan shall be approved and 5 installed prior to grading. 6 8. The City Manager is hereby authorized to execute an 7 agreement on behalf of the City, approved as to form by 8 the City Attorney. 9 10 11 cswest4 Under the power and authority conferred upon this Council by the Charter of said City.
