HomeMy WebLinkAboutResolution 2006-100 N.C.S. 06/05/2006 Resolution No. 2006-100 N.C.S. of the City of Petaluma, California RESOLUTION APPROVING THE PROJECT BUDGET AND AUTHORIZING THE AWARD OF THE CONSTRUCTION CONTRACT FOR THE VARIOUS STREET RECONSTRUCTION PROJECT, PHASE 1 WHEREAS, City staff has worked diligently with Pavement Engineering Inc. to prepare construction bid documents and advertise for construction of this Project; and, WHEREAS, in accordance with California Public Contract Code Section 20688.2 and other applicable law, City staff solicited bids for the Project; and, WHEREAS, the project was bid on May l7, 2006, and three (3) bids were received and opened in accordance with applicable law; and, WHEREAS, the lowest bid for the Project. was from North Bay Construction Inc. for $1,907,734.20 (Base Bid plus Bid Alternative 1 and, WHEREAS, City staff has determined that it is preferable to award the Base Bid plus Alternative 1; and, WHEREAS, a bid protest was received from Ghilotti Bros., Inc. on May 18, 2006 challenging the validity of the North Bay Construction bid and requesting that the project be awarded to Ghilotti Bros., Inc. as the apparent second low bidder with a bid of $2,044,551.98 (Base Bid plus Bid Alternative 1 and, WHEREAS, North Bay Construction responded to the challenge presented by Ghilotti Bros., Inc. on May 23, 2006; and , WHEREAS, Ghilotti Bros., Inc. protest was determined by the City Attorney to be without merit; and, Resolution No. 2006-100 N.C.S. Page 1 WHEREAS, staff has determined that North Bay Construction Inc.'s bid satisfies the bidding requirements for the Project; and, WHEREAS, staff has verified that North Bay Construction Ii~c. possesses a valid California Contractor's License, Class A, number 357560 that qualifies North Bay Constriction Inc. to perform the Project; and, WHEREAS, the Project has a Negative Declaration pursuant to the California Environmental Quality Act ("CEQA") pursuant to Article 19, Section 15301, of Title 14 of the California Code of Regulations ("CEQA Guidelines"). NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. Approves the Project Budget in the amount of $1.,907,734.20. 2. In accordance with California Public Contract Code Section 20688.2 and other applicable law, waives any and all non-conformities in the bid of North -Bay Construction Inc. for the Various Street Reconstruction Project, Phase 1, and finds the bid of $1,907,734.20 (Base Bid plus Alternative l) to be the lowest, responsible bid. 3. Awards the contract for the Various Street Reconstruction Project, Phase 1, to North Bay Construction Inc. in the amount of $1,907,734.20 (Base Bid plus Bid Alternative 1), the amount of the lowest responsible bid, conditioned on North Bay Construction Inc. timely executing the project contract and submitting all required documents, including, but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents 4. Directs staff to issue a notice of award to North Bay Construction Inc. 5. Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma upon timely submission by North Bay Construction Inc. of the Resolution No. 2006-100 N.C.S. Page 2 signed project contract and all other required documents, including, but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 6. Further authorizes the City Manager or his designee to execute on behalf of the City of Petaluma any and all change orders and other amendments to the project contract that are necessary to effectively complete the project and/or to realize project and/or cost benefits for the City of Petaluma and the public. Under the power and authority conferred upon this Council by the Charter of said City.
