Re: RESOLUTION CONCERNED WITH RELOCATION GUIDELINES
The California Relocation Assistance Law (Government Code
Sections 7260 through 1274) provides that all public - agencies adopt
•
guidelines by March 7, 1974, to provide for relocation assistance to
those persons who are displaced from their residence, business or
farms by reason of a public project.
The State Department of Housing and Community Development
adopted guidelines on October 17, 1973 Our guidelines must conform
to the State guidelines. Because the State guidelines are some 37
pages, the resolution presented to you adopts these by reference.
The Relocation Act provides that when a person is displaced
from his home, business or farm by the action of an- agency to con-
struct a public project, that agency (City) must, in addition to
paying appraisal acquisition costs pay certain additional relocation
"eo.sts and provide relocation assistance. Gas tax funds may be used
• for these purposes.
•
The guidelines as prepared are quite detailed and establish
the procedures to be followed in implementing the Act. The payments
under the Act are:
1. The actual reasonable expenses of moving;
2. The actual direct 'loss of personal'property used
in a business or-farm;
•
3. The.actual reasonable expenses of searching for,;,.
replacement business or farm,,
In addition to these expenses, a person, occupying and owning.
a dwel1ing for at least 180 days prior to the commencement of negotia-
tions to acquire the property, is entitled to receive compensation so
that he may obtain equivalent housing. The additional compensation is
not to exceed $15,000 and is to cover increased interest and other debt
service costs.

A renter who iS displaced is entitled to receive money, not to
exceed $4,000 to allow. him to acquire equivalent housing for four years
under lease, or° for a down payment on a house.

the City determines such housing cannot otherwise be made available,
it is required to use authorized funds to provide such housing. If
there is not adequate housing, then the occupant of the property to
be acquired may stay until adequate housing is made available.
Under the'A.ct, there are other rules, one of which is that

praised and thereafter negotiated Its first offer made may not be
lless than its appraisal.

•dum to you merely points out the basic elements and is not intended to
b comptehensive..

It is, suggested that the resolution be adopted and that at
d such time as the City has to acquire property wherein people will be
isplaced, an extensive study session on the guidelines be held. If
there are any immediate questions, I will attempt to answer.
