RESOLUTION APPROVING SALARY AND SUPPLEMENTAL WAGE BENEFITS
FOR MANAGEMENT EMPLOYEES, UNITS 8 & 9
WHEREAS, the City Manager, pursuant to Section 28,
City of Petaluma City Charter, is required and empowered to make a
recommendation to the City Council on matters related to employees'
compensation; and,
WHEREAS, the City Manager has reviewed the attached
Exhibit "A" and Exhibit "B" and recommends approval thereof,
NOW, THEREFORE, BE IT RESOLVED that the salary
and supplemental wage benefits as specified in the attachments for
Management Personnel are approved and shall become effective July 1, 1991.
BE IT FURTHER RESOLVED that it is the City Council
policy that ninety (90) days notice is required by either party ( City
Council and City Manager) prior to termination of services between said
parties.

GENERAL
Section 1. Term
T his compensation plan shall .be for a one (1) year term for the fiscal
year commencing July- 1, 1991, through June 30, 1992.
COMPENSATION

The City shall adopt the following salary ranges for each of . the
employees in the following classifications effective, during the period of
-this Compensation Plan.

Sec-tion 1. -Compensation for Clothing Loss
The City manager is, authorized to ,provide compensation to City
ity
employees-, for loss or. damage. to, their clothing which occurs during the
,course of carrying outan officiAl, duty. A request, fDr compensation
hereunder shall be submitted in writing,, in detail, to the' City Manager
via the department head. concerned.. The amount, of compensation, 'if
any, shall be at the discretion of the City Manager.
Section .4,. Vacation, Payment at Termination
Employees who terminate employment, shall be paid in a lump sum, for*
.all 'accrued vacation leave earned prior to - the effective date of
termination.
Section 5. Sick Leave, . Payment, of
In the event' of the death or retirement of' an employee who, has
completed ten (10), or more years of continuous service with the '.City,
the, employee;should be, -paid or shall receive to - his benefit fifty
percent (50%) of his accumulated but unused sick leave not to 'exceed,
480 hours.
Section 6. . Deferred Compensation
The City of Petalum - a shall make available to the members -of this urlit.,
the C-ity's. Deferred Compensation Plan.
Section n 7. . PERS Employer Paid Contribution
The City shall pay 7% of the miscellaneous employees" share,, and 8% of
the safety employees'. share of the Public Employees!' Retiremeht, System
contribution. The City will also defer the taxes on any remaining
membe±1s, contribution to PERS.
Section .8. Work During a Local Emergency
Members of this, unit-, .'who -are required, to work during ing a Council
..Declared, Local Emergency shall be paid at 1 x, their hourly rate for all
-hours beyond their normal work day.
Section 9. Uniform Allowance.
The classifications of Police Chief and. Fire Chief shall receive;$300 per
-year as a Unifprm ADowance.

INSURANCE
Section 9. Health Insurance
During the period of this Memorandum of Understanding, the City shall
pay any premium increases beyond the current City contributions as
listed below. No increase in the dollar amount of the employee
contributions shall be assessed during the term of this Memorandum of
Understanding, with the exception of the Sonoma County Plan.

Section 10. Dental Insurance
During 'the term of this plan the City shall contribute $66.88 per
month per eligible employee toward the .premium for a group dental
insurance plan. Additionally, the City shall include toward an
Orthodontia plan., $1, 000 per child, at a 50% co -payment rate within
the premium rate.
Section 11. Life Insurance
A.. During the term of this fiscal year the City shall contribute
$.36/$l, 000 per -month per eligible employee toward a group term
life insurance plan in the amount of $10, 000 per employee.
B . Manaqement Life. Insurance shall be in the amount of one and
one-half (1-1/2) times their annual salary rounded. to the nearest
even dollar, i.e., $12,000, $13,000, etc. not to exceed $100,000.
Section 12.' Long -Term Disability
The City shall provide a long-term disability -plan, premium- to be paid
by the City.
Section 13. Vision Insurance
Durincj._.# a term. of this fiscal year the City shall contribute $12.50 per
month peak _ ligible employee for a family vision plan.

LEAVE
Section 14. Vacation
A. "Amounts. All regular employees of the City of Petaluma, after
working one full year are entitled to the equivalent of eighty (80)
hours of vacation with pay in the year following the year in
which vacation is earned.
All regular employees of the City of Petaluma, after. five (5)
years -of continuous service with the iCity, and beginning with the
sixth year, shall be entitled to the "equivalent of one -hundred
twenty (120) hours of vacation per year.
After ten ('10) years, of continuous service with the. City, eight
(8) hours of vacation shall. 'be added for each year of continuous
service to a maximum of one hundred sixty (T50)hours of
vacation.
Section 15. Sick Leave
'A. General Sick leave with pay shall be granted to. allemployees ,as
set forth in this section: Sick leave is not a right which an
employee. may use at his discretion; but rather,'. shall be used
only An case of personal illness,. disability or the serious illness
or injury of an employee's family member which requires- the
employee's " attention. The' term family members; shall .include:
spouse, children, parents, spouse's parents, brothers_ , sisters or
other' individuals whose relationship to the employee is that of a
dependent or near dependent.
B . - Accrual Sick leave. shall accrue -to all full-ti.me employees. at the
rate -of ei_ght hours fAr each month of: continuous service. No
employee shall accumulate more sick leave in, any "year than
provided.
C. .Relationship -to Workers_ Compensation: Benefits shall be payable
in situations, where =employee absence is, due too industrial injury
as provided in California State Workers' Compensation Law. The
amount of, disability payments .paid to the injured employee.. shall
be. deducted, from salary payable to the. employee while on sick -
leave.. During the first three (3) calendar days of. absence for
industrial disability, employees' 'wilt be 'compensated' at their full
rali. of pay without deduction _ from, sick .leave - unless "they are
hospitalized'. Absences resulting in immediate hospitalization or
absences continuing beyond the third day shall be ' `charged -
against the employee at, the rate of one-half (1/2) day for each
day of absence credited or compensated by workers' compensation
insurance, provided the City receives all compensation paid by
workers' compensation payments only, without City payment for
Salary at no loss- of sick leave. Sick leave for industrial injury
shalt not be allowed for , a 'disability resulting from sickness,
self-inflicted injury or willful ,misconduct.

All employees receiving. full salaries in lieu of temporary disability
payments pursuant to Section 4850 Labor Code are entitled to
accumulate sick leave during such periods of disability.
D. Sick Leave .Transfer Policy, Employees wishing to donate hours of
sick leave to another- employee may do so by sending a written
request, approved by their department head, to the Personnel
Office naming the individual to receive, -the sick leave and the
amount donated, with the following restrictions:
1. Employees who wish to transfer sick leave must retain a
minimum of 160 hours sick leave to be eligible to transfer
sick leave.
2. All 'such transfers of sack leave are irrevocable.
I. The employee receiving' the sick leave transfer must have
zero (0) hours . of accrued sick leave, vacation and C T 0 left
on the books.
4. Employees .may not buy or sell sick. leave. ve. Only the time
may .be :transferred.
5. Employees' may not transfer sick leave upon separation of
service. -
Section 16. Bereavement Leave
In the event of the death of an employee's spouse, mother,
step -mother, mother-in-law, father, step -father, father-in-law,
brother, sisfer, child., including an. adopted child, grandchild and
grandparent, an. employee who attends .the funeral shall be granted
time off work ,with pay'. The amount of time off work with pay shall
be only that, which is- required to attend the funeral and make
necessary funeral arrangements, but in- no event shall it exceed three
(3) 'working days. These three (3) days shall not be chargeable to
sick leave. An additional two' (2) days required for necessary funeral
arrangements may be charged " to the .employee's sick leave and any
additional time beyond -these two days may . be charged. to accumulated
vacation or leave 'without -pay. ' Such bereavement leave shall not be
accruable from fiscal year to- fiscal year, nor shall it have any
monetary value if unused.
Section- 17. Holidays.
A. Fixed:._ Holidays. The City shall observe eleven and one-half
(11-1/2) fixed -date holidays. These holidays shall be established
for the City's fiscal year as, determined by City - Council.

B. FloatingHolidaXt. During the period of this Compensation Plan
the City will authorize one (1) "Floating Holiday" per employee,
which may be taken by the employee at a time selected by the
emp]gyee, subject to • operational requirements and approval
determined by the City. Employees hired between July 1 and
December 31 will be. eligible for a "Floating Holiday" during the
course of the Fiscal Year.

Section 19. Leave of Ab-sence without 'Pay
The City Manager may grant. a permanent or- probationary employee

Section '20. Jury Leave
Every classified employee_ of. the City who is- called or _required" to

serve as a -trial juror shall be, entitled to -absent himself from his
duties with the City, during the period of such:-.- service - or while
necessarily being present. in. court as a result of such call. Under
,such circumstances, the employee, shall.'be paid % thedifference between
his, full salaryd payment received by him., except -travel an. any paym PAY
for- such duty.

It 'is un'dersbood that employees, who are, or will retire with A service

retirement shall be able to make a one-time irrevocable conversion of
the City Contribution being made on their behalf to base salary.
Employees who wish to exercise this one-time irrevocable conversion
must meet the following requirements for service retirement.
1.. Minimum fifty-four years of age, and will be retiring no later
than one (1) year from date of conversion.
2. Must submit is letter of intent to retire in order to initiate
the conversion.
Employees who have converted the City payment.of the employee"s'
contribution to PERS and do not retire on the date specified to the
City at the time of conversion, shall owe to the City the increased
costs including but not limited to benefit contributions to PERS.
The costs owed to the City will be from the time of conversion to the
actual date of retirement.

Section 3. Overtime - Police Lieutenants
Overtime at e P

circumstances. for Police, Lieutenants-. and is to be paid at the rate of
the top step, Police Sergeant.
I.. When extralduty is required by, call -out or extended. service,, due
to a major emergency tsituation, i.e.,.:flood, earthquake, SWAT
operation or.other major unusual incidents requiring thepresence
of a Lieutenant.
2. When reouired for the proper.investigation of extremely pressing
personnel,'matbers, such 'as serious, peirisonnel complaints or bfEi?-er
involved shooting, 'when authorized by the. Chief of .Police.
3. Tofill- behind another' Lieutenant to provide adequate shift
supervimon during periods, -of. high activity or speciaI events' with
the approval of the Chief, of Police. -

Section 8. . Holiday Pay..
The City shall, pay -.Battalion Chiefs and Police!, Lieutenant for 'eleven
and one-half (11-1/2); holidays in the month of December in lieu of
giving time off.

Section 9. Court Appearances: Police Management Personnel
The City will compensate a minimum of four (4) hours at time and
one-half for each officer for court appearances on his own time;
additionally, time and one-half (1-1/2) shall be compensated for atl
hours. actually worked in court beyond such four (4) hours.
An employee receiving full salary while not working, pursuant to Labor
Code Section 4850 shall not be granted further compensation for court
time unless this- court time (including all .related professional activities)
exceed the number or f hours in the regula. workday (eight (8) or ten
(10) , depending upon his or her schedule) in one day or 40 hours in
one week; if such court time and ' related professional activities exceed
eight (8) or ten (10) hours in one day (whichever is the applicable
workday or 40 hours. in one week) the employee shall be compensated
for such additional. time at the applicable overtime rate.
Section 10. PERS Employer Paid Contribution
The City shall pay 7% of the miscellaneous: employees' share and 8% of
the safety employees' share of the Public Employees' Retirement System
contribution. The City. will also defer the taxes on any remaining
member's contribution '.to PERS.
Section 11. Work During a Local Emergency
Members of this unit who are required to work during a Council
Declared Local Emergency shall be paid at 1 x their hourly rate for all
hours beyond their normal work day.
Section 12. Uniform Allowance - Public Safetv
The classifications of Police Captain and Police Lieutenant shall recieve
1.5% of the top step'Patrol Officer's annual salary 'effective July 1,
1-991 as the Uniform Allowance.
The classifications of Fire Battalion Chief and Fire Marshal shall
recieve $575.00 as uniform allowance.
Uniform Allowance shall be paid in December.
INSURANCE
Section 13. Health Insurance
During the period of this Memorandum of Understanding, the City shall
pay. any ,ptemium .increases beyond the current City contributions as
listed, below. No. increase in the dollar amount of the employee
contributions shall 'be assessed during the term of this Compensation
Plan, with the exception of the Sonoma County Health Plan.

Police Lieutenant and Captain
Police. midmarigement personnel, upon providing to the Personnel .Office
the POST Management Certificate shall be eligible to receive an
educatiorial incentive in .the amount of $275.. 00:.
Batta]a n_ Chief upon providing to the! Personnel -Office the ' Chief
Officer Certification shall be eligible, to receive. an education incentive
in the amount of $150.00.

LEAVE
Section 19. Vacation
A. Amounts: All regular. employees of the City of Petaluma, after
working one full year are -entitled to the equivalent of eighty (80)
hours of vacation with pay in the year following the year in
which vacation is earned.
All regular employees of the City of Petaluma, after five (5)
years of continuous service with the City, and beginning with the
sixth .year, shall be entitled to the equivalent of one hundred
twenty (120) hours of vacation per year.
After- ten (10) years of continuous service with the City, eight
(8) hours of vacation shall be added for each year of continuous
service to a. - maximum of one hundred sixty (160) hours of
vacation.
B. Scheduling. The times during a calendar year -in which an
employee: may take his vacation shall be determined by the
department head with due respect for the wishes of the employee
and particular regard for the needs of tile- service. If the
requirements of the service are such that an employee cannot take
part or all: of his annual vacation in a particular calendar year,
such vacation shall be taken during the following calendar year.
C . Deferral. In -the event one or more municipal holidays fall within
an annual vacation leave, such holidays shall not be charged as
vacation leave and vacation leave shall be extended accordingly.
D . Fire Battalion. Chiefs' Vacation shall be computed as follows:

Vacation: entitlement accumulated in excess of two years will be
eligible employee- with. the consent - of the head of his
department and the Personnel Officer- may defer 2.33 shifts of his
annual vacation to the- succeeding- calendar year, subject to the
other provisions of this. rule. A written..report: of each deferred
vacation signed by the appropriate: department head 'and the
Personnel: Officer noting the. details shall be kept on file with the
Personnel Offioer.
The 'times during the calendar year in which an employee may
take his vacation shall be determined. by the department head with
due respect for the 'wishes of the employee and particular regard
for , the needs: of the'. service. If, the re ments,' of the'
requirements,' service
are such that: an employee- cannot take part or &U,,6f his annual
..vacation, in' a particular calendar'- Year, such vacation shall be

E. Sick Leave .Transfer Policy Employees wishing to donate
hours of sick leave to .another employee may do so by
sending a written request,, approved by their, department
head:, to the Personnel Office naming the individual to
receive the sick leave and the amount donated, with the
following restrictions:
1. Employees who wish to transfer sick leave must
retain a minimum" of 160 hours sick leave to be
eligible to transfer sick leave.
2. All such transfers of sick leave are irrevocable.
3. The employee receiving the sick leave transfer
must have zero (0) hours of accrued sick leave,
vacation and CTO left on the books.
4. Employees may not buy or sell sick leave, Only
the time may be transferred.
Section 21. Bereavement. Leave
In the event of the death of an employee's . spouse, mother,
step -mother, mother-in-law, father, . steep -father, father-in-law,
brother, sister, child, including an adopted child, grandchild and
grandparent, an employee who attends the funeral shall be granted
time off 'work with pay.. The amount of time off work with pay shall
be only that which- is required to attend the funeral and make
necessary funeral arrangements, but in no event shall it exceed three
(3) working days. These three (3) days shall not be chargeable to
sick leave. An additional two (2) days required for necessary funeral
arrangements may be "charged to the employee's sick leave and any
additional time 'beyond these two days may be charged to accumulated
vacation. or leave without pay. Such bereavement leave shall not be
accruable from fiscal year to fiscal year, nor shall it have any
monetary value if unused.
Section 22. Holidays
A. Fixed Holidays., The City shall observe eleven and one-half
_ (11-1/2) fixed -date 'holidays:. These Holidays shall be established
for . the City'sfiscal year as determined by City Council
-resolution.
B. Floadnq- Holiday. During the period, of this Compensation Plan,
City- will authorize- one (1) "Floating ' Holiday" . per employee, which
may be. taken by the employee at• a time selected by the employee,
subject to operational requirement& and approval determined by
the: City.. Employees hired between July 1 and December 31 will
be eligible for a "Floating Holiday" during the course of 'the
Fiscal- Year.
Section 23'. ' Military Leave
Military leave shall be .arranged in accordance with the provisions of
State .law. A11' employees entitled to military leave shall give the
appointing power. an opportunity within the limits of military
regulations to. determine when such leave shall be taken.

Section 24. Leave of Absence without Pay
The, City 'Manager may grant- a permanent orprobationary employee
leave, of, absence without pay or, seniority fora per enod not to
,tEcde (3) -months. Good cause being shown by a written request,, the
City Manager may extend the leave. of. absence without pay for An
additional period not to exceed six (6) months. No such
, leave shall be
granted. except, upon written. request of the employee setting forth "the
reason for the request, and the approval I will be in writing.- 'Upon
expiration of a regularly approved leave or within 'a reasonable- period
of time after notice to return to duty, the 'employeb shall 'be reinstated
.in, the position held at the time, leave. was granted. Failure on the
part' of an employee on. leave to report promptly at its expiration, or
within a reasonable time after notice to return to duty,, shall be cause
for discharge.
Section 25. - Jury Leave
Every classified employee :of the City who is called or required to
serve as a trial juror shall be entitled to absent himself from his
duties with the City
y during the period 'of such- service' or while
necessarily ssaidly being present in court as a result, of such call. Under
such circumstances, the em'p1byee shall be paid the difference between
his fun,salary and any payment received by himl: except- travel pay,,
for such duty.
Section 26. 'Administrative Leave

It is underst)06d, that. employees who are,,, or will retire- witha,, service
retirement zhall,,be able to make a one-time irrevocable conversion, of
the City Contribution being made on 'their, behalf to base salary.

Employees .who wish to exercise this onetime irrevocable conversion
must meet the following requirements for service retirement.
1. Minimum ,firty-four years of age, and will be retiring no later
than one, (1) year from date of conversion.
2. Must submit a letter of intent to retire in order to initiate
the conversion.
Employees who have converted the City payment of .the employee's
contribution to PERS -and do not retire on the date specified to the
City at the time of • conversion., shall owe too the City the increased
costs including but not limited to benefit contributions to PERS.
Thecosts owed. to the City will be from the time of conversion to the
actual date of retirement.
Section 28. Grievance Procedure
A. Purpose of Rule
(1) To promote, improved employer -employee relations by
establishing grievance procedures on matters for which
appeal or hearing is not provided by other regulations.
(2) To afford employees individually or - through qualified
employee organization a systematic means of obtaining further
consideration of problems after every reasonable effort has
failed to resolve. them through discussions.
(3) To provide, that grievances shall be settled as near as
possible to the pint of origin.
(4) To provide that appeals shall be conducted as informally as
possible.
B . Matters Subject to Grievance Procedure. Any employee. in the
competitive service shall have the right to, appeal under this rule,
a decision affecting his employment over which his appointing
power has partial or complete. .jurisdiction and for which appeal is
not provided, by other regulations or is not prohibited.
C. Informal Grievancer Procedure. An employee who has a problem or
oompiaint. should ''first try to get it _settled through discussion
with- his-Ammediate, supervisor without undue- delay. If, after this
discussion, he does not believe- the problem has been
satisfactorily resolved he shall have the right to discuss it with
his., supervisor's • immediate supervisor, , if - any, in the
administrative service.. Every effort should be made to find an
acceptable solution by informal means at the lower possible level
of supervision. If the employee is not in agreement with the
decision reached by discussion, he shalt then have the right to
file a' format appeal in writing within ten (10) calendar days after
tus imme
receiving the informal decision of diate superior. An
infoormal. appeal shall not be taken above the appointing power.

D. Formal Grievance Procedure (levels -of. review, through- chain of
command)
(1) First level of review.. The appeal shall be presented, in

render his decision and comments in writing and return them
to the -employee within five (5) calendar da-

the appeall. If the employee does not agree with his
supervi.sor's decision, or if no answer has been received

appeal in writing* to his .supervisor's immediate superior.
Failure of the employee to take further action within five (5)
calendar days after receipt of the written decision of his
supervisor, or within..,a 'total of fifteen (15) calendar, days if'
no decision as rendered, will, constitute" a,, dropping of the
appeal.
(2) 'Further" level- or levels- - of - review - as appropriate... The
supervisor receiving the appeal, shall: :review ".it-,. rend , er, this
decision and comments in writing, and return, them to the
employee within, five (5)'; calendar .days after receiving- the
appeal,, if the, employee does not agree with the de-cision,, or

(5) Conduct of Grievance Procedure.
(a) The time limits specified above may be extended to a.
definibe date by: mutal agreement of the employee and
the reviewer concerned.
(b) The employee may request the assistance of another
person of his own choosing in preparing and presenting
his appeal at any level of review.
(c) The- employee and his representative may be privileged
to use a reasonable amount- of work time as determined
by :the appropriate department head in conferring about
and presenting the appeal.
(d) Employees shall be, assured freedom from reprisal for
using the grievance procedures.
