HomeMy WebLinkAboutResolution 91-173 06/17/1991~es~lutl®17 No. 91-173 ~ ~.5. 1 of the City of Petaluma, California 2 3 4 5 A RESOLUTION OF THE CITY COUNCIL OF TIME CITY OF 6 PETALUMA TO IMPOSE A 24-HOUR BAN ON FIREWORKS ANI) 7 ALCOHOL IN LUCCHESI PARK ON JULY 4, 1991 8 9 10 11 WHEREAS, the Fourth of July fireworks display at Lucchesi Park is a popular 12 annual City event, drawing large numbers of citizens; and 13 14 WHEREAS, through the providing of the annual fireworks display, the City of 15 Petaluma gives citizens an opportunity to celebrate the 4th of July in a safe and controlled 16 environment; and 17 18 WHEREAS, during the 1990 Fourth of July Celebration, unruly and intoxicated 19 individuals threw fireworks into the crowd and created a generally unsafe atmosphere for 20 the approximately 10-15,000 people in attendance; and 21 22 WHEREAS, Petaluma Municipal Code section 1.04.O10.K provides for the 23 enactment of a temporary or special law in the form of a resolution which shall constitute a 24 law of the City; and 25 26 WHEREAS, Petaluma Municipal Code section 1.12.010 provides that persons 27 authorized to enforce municipal ordinances, including those defined in Petaluma Municipal 28 Code section 1.04.O10.K may arrest or issue citations for violation of said ordinances or 29 other law. 30 31 NOW, THEREFORE, LET IT BE RESOLVED THAT the City Council of the 32 City of Petaluma, do hereby authorize cone-day ban of fireworks and alcoholic beverages 33 in Lucchesi Park from 1:00 a. m. July 4, 1991 unti18:00 a. m. July 5, 1991.; and 34 35 BE IT FURTHER RESOLVED THAT violation of this resolution shall constitute 36 an unlawful act in a city park, which act shall be an infraction subject to a fine upon 37 conviction of not less than ten, dollars ($10.00) nor more than one hundred dollars 38 ($100.00) for a first offense; not less than twenty-five dollars ($25.00) nor more than two 39 hundred dollars ($200.00) for a second offense; and not less than fifty dollars ($50.00) nor 40 more than five hundred dollars ($500.00) for a third and subsequent offense committed ass. ~~~.......9.1.-1.7.3.......
