CONDITIONS OP APPROVAL
AS APPROVED BY THE PLANNING COMMISSION
• ON MAY 29', 1973'
1. All public improvement's: and easements shown on the Tentative Map will
''be subject to future review; when the improvement plans are subm=itted
to the City for approval-
2. All streets and other public improvements within the subdivision shall
be designed and constructed- in accordance with the requirements and
standards of the City Engineer.
3. Public improvements shall be constructed along Ely Blvd., including
that portion of road along the parcel which is not a part of this
subdivision at the northerly corner of the development, in such a
way as to match with existing improvements on Ely Blvd., and in
accordance with the standards and requirements of the City Engineer'.
4. All street names as indicated on the Subdivision map are strictly
tentative names subject to checking and • review by the Department of
Community Development.
5. The' Final • Map and development shall be geared to the incremental phasing
of -the residential units approved for construction by the City Council's
residential .development control allotment: system. The Tentative Map
shows a total of 110 lots a development allotment of 100 units has
been awarded the subdivision -for the 1973 -74 construction year.
6. All storm drainage improvements shall be designed and constructed in
accordance with the - Sonoma County Water Agency flood control standards
and regulations and- approved by the City Engineer. The drainage pipe
alignments at the northerly corner of ,the subdivision shall be
adjacent to property lines where possible, and future structures on
these lots shall be .set back reasonable distances.
7. At least thirty (30„ days prior to the recordation of any final sub-
division nap; the applicant.shal1 submit to the Planning Commission
the following documents which shall demonstrate to the satisfaction
of the Commission that the total project will be developed and main-
tained in accordance with, the intent and purposes of this proposed
development.

b. The covenants, conditions and restrictions to be recorded.

At 'the building setback line in aCcordanceWith Section 22.7.403 of
the Subdivision Ordinance as amended.
The developer shall work .out an agreement with the owner of the
adjacent property located northeast of Lot #98 to facilitate the
exchange of property which will be necessary to the future
development of that property.
. 11. A complete landscaping plan and grading plah „ including the location
of any fences to be constructed, shall be submitted for final approval
by the Department of Community Development.
12. A six foot high chain link fence shall be installed along Sunnyhills
Drive behind the sidewalk, With landscaping or a hedge planted along
the fence, to provide a visual break between the schOol and the
residential area.

13. The developer shall obtain a rounding easement, from the High
School District for the southwesterly curb return and sidewalk
connection to Ely Blvd. at the intersection of .Ely Blvd. and
Sunnyhills Drive,
• 14. In accordance with Section 22.7.1301 of the Subdivision Ordinance
- the subdivider shall dedicate land, or pay, a fee in lieu thereof for
park and recreational purposes.
15. At the time of Site Plan review, special consideration must be given
to the unusual shape of Lots 071 and 072. Driveway locations and
building orientations shall be made in accordance with the standards
•and requirements of the Director of Community Development as shown
on Exhibit "A”.
16. The developer Shall remove all existing structures scheduled for
removal prior to the issuance of any building permits.
17. All conditions referred to in the City Engineer's letter of May 23,
1973 shall be adhered to.
18. Annexation and,all applicable zoning shall be-approved prior to
approval of the Final Map of this development.

Gentlemen:
Tentative Map - Sunnyhilis Subdivision
Section 22.4902 of the Subdivision Ordinance specifies .
that the City Engineer shall prepare; a written report
of recommendation on the tentative map in relation to
the public improvement requirements: .'of the Subdivision
Ordinance and the provisions of•the Map Act,
Section 22.7.504.4 of the Subdivision - Ordinance requires
"Where frontage roads are not required, residential lots
adjacent to an arterial street shall be served by a local
street ". Lots 'Nos 105, 106, 107, 108, '10 and 110 do
not conform and are fronting directly on the.a
street, Ely Blvd. This is, however,, the last parcel of
land to be developed on the southerly side of Ely Blvd
before the High School. Additionally,, the previously
constructed subdivisions along Ely Blvd, on the west side
of the street, ;have houses fronting on the arterial. Under
these circumstances, it does not seem reasonable to require
back on treatment, for these last six, lots in this area An
exception would seem to be in order.
The subdivider should obtain a curb rounding easement from

Ely Blvd and Sunnyhills Drive.

Section 22.4 609 of the Subdivision Ordinance requires
that the closest City bench mark' shall be used and its
elevation called out on the tentative map. The map, as
submitted, doers not comply with this requirement.
The remnant parcel, adjacent to Lot `98, is in violation

of Section 22.7.40'8 of the Subdivision Ordinance. If
the remnant is dedicated to the adyacent property (not
a part of this subdivision) then it appears as though
Lot 98 will be less than the required 6500 square feet
minimum..

Commission, states., "In accordance with,, Section 22.7.1301 of

s.the Subdivision Ordinance the subdivider, shall dedicate land, I .
.or pay a fee in. lieu thereof for park and recreational pur-
poses.
In evaluating the subdivision with , respect to'the need for
park facilities, it was felt that the Casa Grande School,
which is adjacent to this subdivision, ' would provide ample
open space for 'recreational purposes.,,,Furthermore, the developer
has provided a street along the edge of the school property
which will allow access from the subdivision to the school
property. During the discussion of the Tentative Map at the
Planning Commission meeting on May 29, 1973, it was pointed
out that a 6 -foot fence would be required along the edge of
the school property; however, Mr..Lesly Meyer, Superintendent
.. :','of Schools, indicated that the installation of gates or other •
- I openings would provide accessibility
''In view of. the above considerations the staff feels that it f 1 ;;
is not necessary to require the subdivider to dedicate land
for parks in this instance. In lieu of the dedication of land + ;
the developer should pay a fee equivalent to the value of "
`1.65 acres of land, which is the subdivision ordinance
`i, for 110 lots at 1.5 acres per 100 lots. " ,
