Resolution No. 91-13Z N,~,S, of the City of Petaluma, California i 2 MAKING APPLICATION TO THE LOCAL AGENCY FORMATION 3 COMMISSION (LAFCO) TO INITIATE PROCEEDINGS FOR 4 REORGANIZATION OF CERTAIN PROPERTY KNOWN AS ASSESSOR'S 5 PARCEL NUMBERS 048-190-09 AND 048-080-34 AND 35 6 PURSUANT TO THE CORTESE/KNOX 7 LOCAL GOVERNMENT REORGANIZATION ACT OF 1985 8 9 WHEREAS, after considerable public review and input, the City Council adopted the 10 Environmental Impact Report and related proposals for the River Oaks/Petaluma Outlet 11 Village project; and 12 13 WHEREAS, in order to implement the project, it is necessary to annex certain property 14 known as Assessor's Parcel Numbers 048-190-09 and 048-080-34 and 35; and 15 16 NOW, THEREFORE, BE IT RESOLVED that pursuant to the Municipal Organization 17 Act (Government Code 35000 et. seq.), the Petaluma City Council hereby makes 18 application to the Local Agency Formation Commission of Sonoma County for a proposed 19 reorganization as follows: 20 21 An Annexation to the corporate boundaries of the City of Petaluma of territory 22 known as Assessor's. Parcel Numbers 048-190-09 and 048-080-34 and 35: 23 24 Said territory is uninhabited and is comprised of approximately 24.98 acres, 25 as described more completely in Exhibit A (legal description and map). 26 ~r.~....~..,.,...__.-._.- 27 BE IT FURTHER RESOLVED that the reasons for the requested reorganization are: 28 29 1. The properties are contiguous to the City and are within the adopted Sphere of 30 Influence and General Plan Urban Limit Line of the City of Petaluma. 31 32 2. The City has completed an extensive environmental review ,process for the area 33 culminating in the approval of the project Environmental Impact Report. 34 35 3. The owner of said property has initiated said annexation. 36 37 4. By Ordinance No. 1853 N.C.S., the City of Petaluma has prezoned the various 38 properties to Planned Community District. Res. This annexation is consistent with the objectives and policies of the General Plan, as 3 documented elsewhere in the FEIR and project actions. 4 5 6. This annexation will enable several objectives and policies of the General Plan to be 6 achieved, including Objectives (g) and (h) of Chapter 8, Local Economy; Objectives 7 (a), (c), and (i) of Chapter 5, The River; Objective (c) of Chapter 6, Open Space, 8 Conservation and Energy. 9 10 BE IT FURTHER RESOLVED that the ..requirements of the California Environmental 11 Quality Act (CEQA) and its Guidelines have been satisfied and are thoroughly addressed 12 in the Environmental Impact Report adopted by City Council Resolution 90-420 on 13 December 17, 1990 and incorporated herein by reference. 14 15 The City Clerk is hereby authorized and directed to file a certified copy of this resolution 16 with the Executive Officer of the Sonoma County Local Agency Formation Commission. 17 18 19 20 rolafco/ro disk2 Under the power and. authority conferred upon this Council by the Charter of said City.
