HomeMy WebLinkAboutResolution 91-133 05/20/1991r, __ Resolution No. a ~- ~~.~ N C.S. ~- of the City of Petaluma, California 1 2 RES®LUTI®N ESTABLISIIING A P®LICY TO PRESERVE PUBLIC 3 STREET LANDSCAPE PLANTERS 4 5 WHEREAS, the City has established, through provisions within its .General Plan and 6 policy, that street trees and landscape planter strips enhance the function, safety and 7 appearance of the City's streets; and 8 9 WHEREAS, the Ad Hoc Tree Preservation Committee, composed of representatives of 10 the Planning Commission, Recreation, Music and Parks Commission, Site Plan and 11 Architectural Review Committee, and a private citizen, has recommended adoption of a 12 City policy favoring the retention and preservation of existing public street landscape 13 planters for the purpose of encouraging street tree plantings; and 14 15 WHEREAS, the City Planning Commission, Recreation, Music and Parks Commission, 16 and Site Plan and Architectural Review Committee have each considered the matter and 17 forwarded their separate recommendations in favor of such policy; and 18 19 WHEREAS, the City Council, upon review of all information forwarded by the 20 aforementioned bodies, has found public street landscape planters to contribute to the 21 aesthetic beauty of Petaluma's streetscape, and that preservation is feasible through 22 implementation of existing City processes; 23 24 NOW, THEREFORE, BE IT RESOLVED, that the Public Works Director shall 25 implement the policy hereinafter stated, to ensure the retention and preservation of 26 existing public street landscape planters: 27 28 A. All existing public street landscape planters shall be retained and preserved 29 for the purpose of providing live landscaping along the frontages of City 30 streets. To this end, covering, paving, sealing, or filling of public landscape 31 planter areas with impervious materials shall be prohibited. 32 33 B. When, during the course of a development project, it is necessary to remove 34 or reconstruct public street improvements (i.e., curb, gutter, sidewalk), they 35 shall be reconstructed to preserve or restore any previously existing public 36 landscape planter. Existing street trees and other landscaping shall be Res. N~ ... ;v.cs. 1 9.1._..13.3..... f 1 preserved to the extent possible, or replaced. to the satisfaction of City staff. 2 Required encroachment, excavation or tree removal permits shall be 3 obtained prior to commencement of proposed work. 4 5 C. Exceptions. 6 Sections A and B shall not apply to access ways permitted under Section 7 13.04.110 of the Petaluma Municipal Code as exempted encroachments. 8 9 D. Subsequent to adoption of this resolution, any unauthorized work conducted 10 within public right-of-way landscape areas shall be brought into conformance 11 with the intent and provisions of this policy, and applicable provisions of the 12 Petaluma Municipal Code pertaining to encroachments on City property. 13 Upon findings of such unauthorized work, the City shall require removal of 14 impervious material installed, and restitution of previously existing 15 landscaping, pursuant to the procedure set forth under Municipal Code 16 Section 13.04.150. 17 18 E. Any appeal of the determination of the Public Works Director shall be 19 processed pursuant to Municipal Code Section 13.04.160. 20 21 22 resotree/councils Under the power and authority conferred upon this Council by the Charter of said City.
