HomeMy WebLinkAboutResolution 91-090 04/15/1991' FZCSOIUtI®rl Nom. 91-90 N ~.5. of the City of Petaluma, California 1~ 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 RESOLUTION REPEALING RESOLUTION 7038 AND ADOPTING NEW REGULATIONS REFERRING APPLICATIONS FOR DEMOLITION PERMITS FOR STRUCTURES WITH POTENTIAL HISTORICAL OR CULTURAL SIGNIFICANCE TO THE HISTORIC AND CULTURAL PRESERVATION COMMITTEE FOR REVIEW AND DETERMINATION WHEREAS, the Petaluma City Council finds buildings of cultural or historical significance to be a benefit to the community; and WHEREAS, the Petaluma City Council has established an Historic and Cultural Preservation Committee; and WHEREAS, the purpose of the Historic and Cultural Preservation Committee is to review proposals for alteration (including demolition} of buildings having potential cultural or historical significance; and WHEREAS, culturally or historical significant buildings are those identified by being listed on a local, state, or national historical register or which warrant being listed on such a register; and WHEREAS, demolition permits for buildings of cultural and historical significance may from time to time be submitted to the Community Development Department; and 25 NOW, THEREFORE, BE IT RESOLVED that the City Council hereby adopts the 26 following procedural regulations for demolition permits affecting any building with 27 potential cultural or historical significance. 28 29 Applications for demolition permits shall be referred to the Historic and Cultural 30 Preservation Committee by the Community .Development Department for review 31 and determination, except permits for buildings posing an immediate danger to the 32 public's safety, health, and welfare as determined by the Chief Building Inspector 33 and/or those applications of a routine minor nature not warranting further review as 34 determined by the Director of Community Development. 35 36 Kes. N.C.S. `- 1 The determinations of either the Community Development Director and/or Chief 2 Building Inspector may be appealed to the Historic and Cultural Preservation 3 Committee. 4 5 When the Historic and Cultural Preservation Committee determines the structure 6 not to be of cultural or historic significance, the application shall be returned to the 7 Director of Community Development with afinding- of non-significance and the 8 demolition permit issued forthwith. In cases where the Historic and Cultural 9 Preservation Committee determines the structure has cultural or historical 10 significance, the Committee shall make the findings as outlined below and deny the 11 request for demolition of such applications and forward its decision to the 12 Community Development Director. 13 14 1. This structure is of historic or cultural significance owing to it being listed on 15 a local, state or national register or survey. 16 2. The structure is eligible for listing on a local, state or national register. 17 3. That demolition of said structure will be detrimental to the aesthetic and 18 economic character of the community. 19 20 The determination of the Historic and Cultural Preservation Committee may be 21 appealed to the City Council consistent with Section 26-308 of the Zoning 22 Ordinance regarding appeal to City Council. 23 24 urmdemo /council-3 Under the power and authority conferred upon this Council by the Charter of said City.
