ESTABI.ISIIING TRAFFIC IMPACT FEE
PURSUANT TO MLTNICIPAI, C®DE SECTION 11_.80.050
WIIEREAS, on January 22, 1991, the City Council adopted Ordinance 1837
NCS which adds Chapter 11.$0 (Traffic Impact Fee on Development) to the
Petaluma Municipal Code; and
WIIEREAS, Section 11.80.030(J) of the Municipal Code provides that the net
Peak Hour Trip Rate for each Land Use Category steal] be established by resolution
of the City Council; and,
WIIERE.~S, Section 11.80.00 of the Municipal Code provides that the rate of
the Traffic Impact Fee shall be calculated in accordance with the procedures i n
section 1.1..80.050 and established by resolution of the City Council; and
~'~'HEREAS, on February 19, 1.991, the City Council held a public hearing tcf
set the rate of the 'T'raffic Impact Fee in. accordance with the procedures in Section::
1.1.80.OS0 of the Municipal. Code; ar-d
'v~~I-IEREAS, at a nublie hearing the City Council considered testimony a~~-:.1
c~,i-resl~c~ndence from members of the public and. staff; and
~t~tlEtI:EAS, the City Council hereby adopts and incorporates herein by tl;is
rc~fert•ence the findings and determinations attached hereto as Exhibit A.

4 The City Council of the City of Petaluma finds and determines as follows:

6 1. The,Peak Hour Trip Rates listed in this Resolution represent a
7 reasonable estimate of the actual trip ge eration rages for the various land
8 use categories identified.

10 2. The Transportat`ign Improvements. necessaiy to implement the
11 Transportation Element of the City General Plan and to reduce the adverse
12 impacts .caused by the increased traffic volume generated'by future ,growth
13 are those improvements identified in the City General Plan, the Economic
14 and Planning System Study, and other documents referenced therein. The
15 need'for these`Transportation Improvements is directly related to the types
16 of develo,prnent anticipated in the are s covered by the various Land Use
17 Categories.

19 3. The total cocas riecessary to construct or provi e the Transportation
20 Improvements for all development (not including frontage improvements
21 expected to: be required pursuant to the City's Building, Zoning and
22 Subdivision Ordinances) are estimated to equal the sum.of $79,979.,000. Of
23 these costs, $20;626,6:53 wi 1 benefit existing development (Exhibit B).

25 4. At the: present. time, there. is identfied'$30„1'8"6,.107 in special
26 assessments funds that will be.available to pay for the transportation
27 improvement costs benefiting new developpment. Th:e net transportation
28 improvement costs to be funded from fees is estimated at $29,827,500
29 (Exhibit C).

31 5. The, estimated peak hour Grip rates from '1990 to 2005 are 63,79.0 of which
32 38,031 (59.G%:J are attributable to reside~nfiial growth. and. 25,759 (40.4%)
33 are attributable to non-reside tal growth (Exlii'bt D).

35 6. The percentage of .,growth by residential or non-residential trips is
36 applied to the t,r.ansportation.improvement costs attributed to new
37 development. The special assessment credits :are subtracted to generate a.
3.8 net transpor.t'ation impro~.ement cost of $2:1,538;943 fo'r residential growth
39 and $7,748,557 non-residential growth (Ex•hibit E).

41 7. T,he number of addtional.r,esidential units is estimated to be 7;5.0.0 and
42 the increase.of°non-residential square footage~s estimated to be 6,000,000.

4.4 8. The riet`transp.ortation post is divided by the units of growth to result in a
4'S traffic impact fee for a P.M. peak hour trip of $2;872for residential
46 deve;lo.pment per unit and $1,291 for non-residential development per 1,000
47 square feet (Exhibit E).

49 9: 'Fhe revenues from-thee traffic impact.fees wil-l be used to pay for the
54 transport ~at'ion improvements necessitated by new development.
