HomeMy WebLinkAboutResolution 91-035 N.C.S. 02/04/1991it -i. ~ZeSOIUtI®1'1 ~®. 91-35 N ~.~. of the City of Petaluma, California 1 2 3 4 A RESOLUTION AMENDING RESOLUTION N0.90-243 5 TO PERMIT REVISED PHASING FOR THE MOUNTAIN VALLEY 6 (FORMERLY MORNINGSIDE) TENTATIVE SUBDIVISION MAP 7 8 WHEREAS, the City of Petaluma adopted Resolution No. 90-243 approving the tentative 9 subdivision map for the Mountain Valley residential development; and 10 11 WHEREAS, tentative map condition number 1.e. provided for the construction of all 12 streets and utilities to be completed with the first phase of development; and 13 14 WHEREAS, the owner and developer, Cherry Lane Associates, has filed with the City an 15 application to revise the phasing of the development due to depressed economic 16 conditions; and 17 18 WHEREAS, Community Development and Engineering staff have determined that the 19 proposed revisions conform to the requirements of the Subdivision Ordinance and the 20 General Plan for the area; 21. 22 NOW, THEREFORE, BE IT RESOLVED that the City Council of Petaluma hereby 23 amends Resolution No. 90-243, Condition 1.e., relating to phasing of streets and utilities, by 24 substitution and addition of the following: 25 26 1.e. The unit phasing shown on the Tentative Map does not indicate phasing of 27 the streets and utility improvements. Therefore, all streets and utilities 28 shown within this development shall be constructed concurrently with each 29 phase of unit development they are intended to serve. All public street 30 rights-of-way and utility easements required for these improvements shall be 31 dedicated with the first final map, with all future lot areas labeled as 32 remainder. 33 34 8. The Urban Separator and public park site portions of the development shall 35 be dedicated with the first final map. An agreement shall be recorded with 36 the map specifying the timing of required improvements to these areas to 37 coincide with completion of each phase of development, or as agreed to with 38 the Old Adobe School District, whichever occurs first.
