HomeMy WebLinkAboutResolution 2006-078 N.C.S. 05/15/2006 Resolution No. 2006-078 N.C.S. of the City of Petaluma, California AWARDING A CONSTRUCTION CONTRACT FOR THE 2005-2006 WATER SERVICE REPLACEMENT PROJECT WHEREAS, the Water Service Replacement Project ("Project") is included in the Department of Water Resources and Conservation Fiscal Year 2005-2006 Capital Improvement Program Budget; and, WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section 20162 and other applicable law, the City of Petaluma solicited bids for the Project; and, WHEREAS, three (3) bids for the Project were received on April 27, 2006, and opened in accordance with California Public Contract Code. Section 4105.5 and other applicable Taw; and, WHEREAS, the apparent low bid for the Project was submitted by Michael Paul Company, Inc.; and, WHEREAS, the City staff has verified that Michael Paul Company, Inc. possesses a valid California Contractor's license, Class A, license number 386001, expiration date October, 31, 2006, that qualifies Michael Paul Company, Inc. to perform the Project. NOW, THEREFORE, BE IT RESOLVED by the Petaluma City Council that: 1. The low bid is accepted. 2. The contract is hereby awarded to Michael Paul Company, Inc., 1200 Casa Grande Road, Petaluma, CA 94954, the low bidder. Resolution No. 2006-078 N.C.S. Page 1 3. This resolution shall become effective immediately. 4. The Director of Water Resources and Conservation is hereby delegated authority to execute Project Contract Change Orders up to the contingency amount of $107,000. 5. All portions of this resolution are severable. Should any individual component of this resolution be adjudged to be invalid and unenforceable by a body of competent jurisdiction, then the remaining resolution portions shall be and continue in full force and effect, except as to those resolution portions that have been adjudge invalid. The City Council of the City of Petaluma hereby declares that it would have adopted this resolution and each section, subsection, clause, sentence, phrase and other portion thereof, irrespective of the fact that one or more section subsection, clause sentence, phrase or other portion may be held invalid or unconstitutional. BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute the contract with Michael Paul Company, Inc. subject to the review and approval of all contract documents, insurance certificates and bonds by the City Attorney. Under the power and authority conferred upon this Council by the Charter of said City.
