2 RESOLUTION APPROVING THE PCD DEVELOPMENT PLAN FOR REDWOOD
3 BUSINESS PARK (PHASE ONE) LOCATED IN THE VICINITY OF OLD
4 REDWOOD HIGHWAY AND REDWOOD WAY, AP NO.'S 137-011-01, 02,
5 13, 14 AND 50-53; 137-160-01 AND 02-20

7 WHEREAS, by Ordinance No. 1838 N.C.S., Assessor's Parcel Numbers 137-011-01, 02,
8 13, 14 and 50-53; 137-160-01 and 02-20 have been rezoned to Planned Community District
9 (PCD); and
10
11 WHEREAS, by action taken on November 13, 1990, the Planning Commission considered
12 and forwarded a recommendation to the City Council on the development plan for said
13 Planned Community District;

15 NOW, THEREFORE, BE IT RESOLVED that the City Council hereby adopts the
16 following findings:

18 PCD Findings:
19 1. The development plan, as conditioned, is in .substantial harmony with the General
20 Plan of the City of Petaluma, and is coordinated with existing and planned
21 development of the surrounding areas.

23 2. The existing streets and thoroughfares are suitable and adequate to serve the
24 proposed uses and the anticipated traffic which will be generated thereby.

26 3. The facts submitted with the application establish that:
27
28 a. Development within the P-C District exists.
29
30 b. The development plan is appropriate in area, location and overall planning
31 to the purpose intended. The design and development standards are such as
32 to create an environment of sustained desirability and stability. Such
33 development will meet in performance standards established at Article 22
34 and will be in harmony with the character of the surrounding areas.

36 BE IT FURTHER RESOLVED THAT the City Council hereby adopts the following
37 conditions:

1 PCD Development Plan Conditions:
2 1. The sign program adopted as part of the PCD regulations by reference is subject to
3 approval by the Site Plan and Architectural Review Committee (SPARC). The
4 PCD program, design guidelines, and CC&R's shall be revised as required by this
5 approval and by SPARC approval and a copy of the revised document(s) shall be
6 provided to the Community Development Department prior to issuance of any sign
7 permit within this PCD zone district.

9 2. PCD zoning regulations, Design Guidelines, and CC&R's must be adequately cross-
10 referenced to incorporate any City-approved revisions, modifications or exceptions,
11 subject to staff approval within 60 days of approval of PCD rezoning.

13 3. Reference to retail commercial shall be deleted from Section A.10 of the zoning
14 regulations. Section A.9 shall be deleted.

16 4. Section A.11 of the proposed zoning regulations (Permitted Principal Uses) shall be
17 revised as follows:

19 11. Retail commercial facilities designed to primarily serve the Redwood
20 Business Park Phase I and surrounding business employees. Such uses are
21 limited to uses permitted in .Paragraph 3 above; optometrist and other
22 medical offices if parking is deemed adequate by the Community
23 Development Department; legal and insurance offices; stock and real estate
24 brokerage, indoor recreation facilities (e.g., health clubs) if parking is
25 deemed adequate by the Community Development Department; and
26 restaurants and other food service facilities (excluding fast food and drive-
27 throughs).

29 5. References to the C-H zone shall be deleted from the zoning regulations, design
30 guidelines and CC&R's. References to retail commercial uses in the Design
31 Guidelines and CC&R's shall be deleted except as allowed per Condition 5 below.

33 6. Any retail commercial use, not specifically permitted per Section A.11, shall be
34 deemed a conditional use, subject to administrative approval (i.e., a minor use
35 permit) if deemed appropriate by the Zoning Administrator. In either case, traffic
36 and parking impacts shall be determined on an individual basis and may render a

1 particular retail commercial use inappropriate. Any retail commercial use shall
2 meet all of the following criteria:
3 Either:
4 a. The retail use shall be clearly secondary but also related to a primary
5 industrial use located on the same site; and
6 b. Goods offered for sale must be produced on the premises; and
7 c. Exterior presentation (display, signs, etc.) shall not be of a retail
8 nature.

10 d. Use shall provide either business and professional services directly
11 supportive to industrial workplace uses, or goods and services needed
12 by local industrial workers (pursuant to Section 8.3 of the General
13 Plan).

15 7. Design Guidelines Section II.C.6 (page 5) shall be revised to reference PCD zoning
16 regulations rather than the Zoning Ordinance.

18 BE IT FURTHER RESOLVED that the City Council finds that the requirements of
19 California Environmental Quality Act Guidelines have been satisfied and hereby
20 incorporated by reference the Environmental documentation adopted by Resolution No.
21 91-7 N.C.S. on January 22, 1991.
