2 RESOLUTION APPROVING ISSUANCE OF A MITIGATED NEGATIVE
3 DECLARATION PURSUANT TO CEQA FOR THE APPROVAL OF A
4 FOUR-LOT SUBDIVISION REQUIRING FOUR VARIANCES AT
5 422 CHERRY STREET, AP N0.006-021-11
6 (CHERRY STREET PARTNERS)

8 WHEREAS, the City Council has reversed the decision of the Planning Commission to
9 deny three variances for substandard lot depth and one variance for substandard lot width
10 and to impose a condition requiring redesign to a three-lot subdivision; and
11
12 WHEREAS, an initial study has been prepared for the proposed use; and,
13
14 WHEREAS, the results of this study have determined that approval of this use will not
15 trigger any significant adverse environmental impacts that cannot be mitigated through
16 conditions of approval;

18 NOW, THEREFORE, BE IT RESOLVED that the issuance of said Mitigated Negative
19 Declaration pursuant to the California Environmental Quality Act is hereby approved,
20 based upon the following findings:

22 1. The project, as conditionally approved, does not have the potential to degrade the
23 quality of the environment, substantially reduce the habitat of a fish or wildlife
24 species, cause a fish or wildlife population to drop below self-sustaining levels,
25 threaten to eliminate a plant or animal community, reduce the number or restrict
26 the range of a rare or endangered plant or animal or eliminate important examples
27 of the major periods of California history or prehistory.

29 2. The project, as conditionally approved, does not have the potential to achieve short-
30 term to the disadvantage of long-term, environmental goals.

32 3. The project, as conditionally approved, does not have impacts which are individually
33 limited, but cumulatively considerable.

35 4. The project, as conditionally approved, does not have environmental effects which
36 will cause substantial adverse effects on human beings, either directly or indirectly.

1 5. The project is consistent with and further promotes the objectives, goals, and
2 policies of the General Plan.
