2 RESOLUTION APPROVING AN AMENDMENT TO THE UNIT DEVELOPMENT
3 PLAN FOR SOUSA SUBDIVISION, LOCATED BETWEEN PAULA LANE AND
4 ELM DRIVE

7 WHEREAS, by Ordinance No. 1606 N.C.S., Sousa Subdivision was rezoned to Planned
8 Unit Development; and,

10 WHEREAS, by action taken on November 27, 1990, the Planning Commission
11 recommended approval of an amended final unit development plan for said subdivision to
12 revise development standards pertaining to Lots 1 through 4, 7 and 13 through 15 (Unit 2).

14 NOW, THEREFORE, BE IT RESOLVED that the City Council hereby adopts the finding
15 as set out hereinafter:

17 1. Said amendment to the Sousa Planned Unit Development complies with the
18 original findings set forth in Resolution No. 85-63.

20 2. Said amendment is categorically exempt from the- requirements of the
21 California Environmental Quality Act.

23 NOW, THEREFORE, BE IT FURTHER RESOLVED that the unit development plan
24 previously approved for the project by City Council Resolution. 85-63 is hereby amended as
25 follows:

27 The following language shall be incorporated into the Development Standards:

29 "Grading and building height restrictions shall be evaluated on an individual
30 basis for Lots 1 through 4, 7 and 13 through 15 (Unit 2). A reduced building
31 height may be required if deemed appropriate by SPARC. Waivers of
32 grading and/or stricter height limits may be warranted if reduction in
33 building massing or reduction~in privacy intrusion~.to~neighboring properties
34 is achieved.

36 Preliminary SPARC review of development proposals on Lots 1 through 4, 7
37 and 13 through 15 is encouraged. Immediate neighbors will be notified of
38 preliminary and SPARC review. SPARC submittal requirements for Lots 1

1 through 4, 7 and 13 through 15; view corridors and section drawings from
2 project site to downhill residences; section drawings of proposed residence;
3 and an expanded representation of surrounding uses (particularly downhill).

5 Additional engineering is required with SPARC application for each lot, as
6 deemed appropriate by City staff, to address impact of grading in relation to
7 surface and/or subsurface drainage to adjacent properties."
