HomeMy WebLinkAboutResolution 2006-073 N.C.S. 05/01/2006 Resolution No. 2006-073 N.C.S. of the City of Petaluma, California RESOLUTION AUTHORIZING EXECUTION OF COOPERATIVE AGREEMENT NO. M70604 BETWEEN THE CITY OF PETALUMA AND SONOMA COUNTY TRANSPORTATION AUTHORITY TO PROVIDE MEASURE M FUNDING FOR THE RIVER TRAIL ENHANCEMENT PROJECT WHEREAS, the 2004 Measure M Sonoma County Traffic Relief Act Expenditure Plan (hereinafter Expenditure Plan) includes $2,000,000 in 2004 dollars from the Bus, Rail and Bicycle & Pedestrian category for the Petaluma River Trail Enhancement Project: and, WHEREAS, the Measure M program is managed by the Sonoma County Transportation Authority (hereinafter "Authority"); and, WHEREAS, the City of Petaluma ("City") seeks this Measure M funding from the Authority for the purpose of constructing a bicycle and pedestrian pathway along the Petaluma River (hereinafter "Project") in conformance with the 2000 Petaluma River Access and Enhancement Plan; and, WHEREAS, the City and the Authority desire to enter into a Cooperative Funding Agreement to define a framework to enable the two parties to deliver the Project to the City; and., WHEREAS, by Resolution 2006-072 N.C.S., adopted May 1, 2006, the City Council has consented to use of PCDC funds to finance and in part to fund the Project in accordance with California Health and Safety Code Sections 33421.1 and 33445; and, WHEREAS, by Resolution 2006-072 N.C.S., adopted May 1, 2006, the City Council has authorized and directed that a joint powers agreement between the City and the Petaluma Community Development Commission ("PCDC") be executed on behalf of the City to provide for cooperation between the City and the PCDC regarding financing and construction of the Project, with the PCDC providing project financing and the City utilizing Measure M funding to partially reimburse PCDC Project expenditures in accordance with a cooperative agreement between the City and the Authority; and, Resolution No. ?006-073 N.C.S. Page 1 WHEREAS, by PCDC Resolution 2006-09, adopted May 1, 2006, the PCDC Board has authorized and directed that that same joint powers agreement between the City and the PCDC governing cooperation regarding financing and construction of the Project be executed on behalf of the PCDC. NOW, THEREFORE, BE IT RESOLVED that the .Mayor is hereby authorized and directed to execute Cooperative Funding Agreement No. M70604 with the Authority. BE IT FURTHER RESOLVED, that the Director of Public Works is hereby authorized and directed to execute such other documents as may be required by the Authority, consistent with this resolution and the Cooperative Agreement, to secure the funding described in the Expenditure Plan for the Petaluma River Trail Enhancement Project.
