HomeMy WebLinkAboutRESOLUTION 2024-052 N.C.S. 06/03/2024 DocuSign Envelope ID:615B504C-56D7-477F-905B-9178294BB6CE Resolution No. 2024-052 N.C.S. of the City of Petaluma, California RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA CALLING FOR AND GIVING NOTICE OF A GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 5, 2024, FOR THE ELECTION OF CERTAIN OFFICERS AS REQUIRED BY THE PROVISIONS OF THE LAWS OF THE STATE OF CALIFORNIA AND THE CHARTER OF THE CITY OF PETALUMA WHEREAS, under the provisions of Section 4 of Article III of the Charter of the City of Petaluma and the laws of the State of California, a general municipal election shall be held on November 5, 2024; and WHEREAS, there shall be placed on the November 5, 2024 ballot the regular election of three city councilmembers, representing Districts 4, 5, and 6; each to serve four-year terms expiring December 31, 2028; and WHEREAS, the proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378, in that adopting resolutions calling for and noticing a municipal election does not meet CEQA's definition of a "project," because the action does not have the potential for resulting either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment,and because the action constitutes continued organizational or administrative activities of government that will not result in direct or indirect physical changes in the environment. NOW, THEREFORE,BE IT RESOLVED,by the City Council of the City of Petaluma as follows: 1. The above recitals are declared to be true and correct and are incorporated into this resolution as findings of the City Council. 2. Pursuant to the requirements of the State of California and the Petaluma City Charter, there is called and ordered to be held in the City of Petaluma, California, on Tuesday, November 5, 2024, a general municipal election for the purpose of electing three city council members, representing Districts 4, 5, and 6; each to serve four-year terms expiring December 31, 2028. 3. The ballots to be used at the election shall be in the form and content as required by law. 4. The City Clerk is authorized, instructed, and directed to coordinate with the County of Sonoma Registrar of Voters to procure and furnish any and all official ballots, notices, printed matter and all supplies, equipment, and paraphernalia that may be necessary in order to properly and lawfully conduct the election. 5. The polls(vote centers)for the election shall be open at seven o'clock a.m. of the day of the election and shall remain open continuously from that time until eight o'clock p.m. of the same day,when the polls(vote centers) shall be closed,pursuant to Election Code §10242, except as provided in §§14212 and 14401 of the Elections Code of the State of California. 6. In all particulars not recited in this resolution, the election shall be held and conducted as provided by law for holding municipal elections. 7. The notice of the time and place of holding the election is hereby given and the City Clerk is authorized, Resolution No. 2024-052 N.C.S. In the event of a tie vote (if any two or more persons receive an equal and the highest number of votes for an office) as certified by the County of Sonoma Registrar of Voters, the City Council, in accordance with Petaluma City Charter Section 13, shall appoint one of the persons receiving such tie vote to fill such office as in the case of a vacancy therein. 9. The City Council authorizes the City Clerk to administer said election and all reasonable and actual election expenses shall be paid by the City upon receipt of a properly submitted bill.
