HomeMy WebLinkAboutRESOLUTION 2024-072 N.C.S. 06/17/2024 DocuSign Envelope ID: F9470FF8-59A3-44B2-99BF-E2BO5BC04DO9 Resolution No. 2024-072 N.C.S. of the City of Petaluma, California RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA ACCEPTING BIDS AND AWARDING CONTRACTS TO THE LOWEST RESPONSIBLE BIDDERS FOR FURNISHING CHEMICALS FOR WASTEWATER TREATMENT FOR FISCAL YEAR 24/25 AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY AGREEMENTS OR PURCHASE ORDERS WHEREAS, the City of Petaluma uses bulk chemicals in its operation of the Ellis Creek Water Recycling Facility; and WHEREAS, the City of Petaluma joined the North Bay Agency Chemical Pool (NBACP) in 2009 to obtain the lowest possible pricing through joint purchasing; and WHEREAS, the NBACP conducted a competitive bid process for chemicals commonly used at water and wastewater treatment facilities; and WHEREAS,the NBACP issued an Invitation to Bid on April 3, 2024, and bids were received and opened on May 6, 2024, in accordance with applicable law; and WHEREAS, the City of Petaluma conducted a competitive bid process for specialty chemicals used at the Ellis Creek Water Recycling Facility; and WHEREAS,the City of Petaluma issued an Invitation to Bid on April 2,2024, and two(2)bids were received and opened on May 2, 2024, in accordance with applicable law; and WHEREAS,the lowest responsive bidders for chemicals bid through the NBACP were: 1. Thatcher Co. of CA for Sodium Hypochlorite 2. Univar for Sodium Bisulfite 3. Pennco for Ferric Chloride; and WHEREAS,the lowest responsive bidders for specialty chemicals bid by the City of Petaluma were: 1. USALCO for Aluminum Chlorohydrate or equivalent 2. SNF/Polydyne Inc. for C-6288 polymer or equivalent(solids thickening) 3. SNF/Polydyne Inc. for WE-2273 polymer or equivalent(solids dewatering); and WHEREAS,the time to challenge these bids has lapsed; and WHEREAS, as a member of NBACP, the City of Petaluma is entitled to purchase bulk chemicals from the NBACP's low bidders at the bid price stated; and WHEREAS,the bulk chemical purchases bid by the NBACP satisfy the purchasing requirements of Petaluma Municipal Code Chapter 4.04 pursuant to Petaluma Municipal Code Section 4.04.100, "Cooperative Purchasing Programs;" and WHEREAS, purchasing chemicals to treat wastewater at the Ellis Creek Water Recycling Facility is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301 (existing Resolution No. 2024-072 N.C.S. Page 1 DocuSign Envelope ID:F9470FF8-59A3-44B2-99BF-E2BO5BC04DO9 facilities), which categorically exempts projects needed for the operation of existing structures and equipment involving negligible or no expansion and these chemicals are required for the operation of the already existing Ellis Creek Water Recycling Facility; and WHEREAS, the City Council budgeted funds for Fiscal Year 24/25 to purchase chemicals used at the Ellis Creek Water Recycling Facility. NOW, THEREFORE,BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. Declares the above recitals are hereby declared to be true and correct and are incorporated into this resolution as findings of the City Council. 2. Finds that purchasing chemicals to treat wastewater at the Ellis Creek Water Recycling Facility is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301 (existing facilities), which categorically exempts projects needed for the operation of existing structures and equipment involving negligible or no expansion and these chemicals are required for the operation of the already existing Ellis Creek Water Recycling Facility. 3. Authorizes the City Manager to award bids and execute all necessary documents with the following vendors for the purchase of chemicals listed below for fiscal year 24/25: a. Thatcher Co. of CA for Sodium Hypochlorite (12.5%), $2.49/gallon,plus applicable sales tax,not to exceed$545,310.00. b. Univar for Sodium Bisulfite (25%), $2.40/gallon, plus applicable sales tax, and not to exceed $105,120.00. c. Pennco for Ferric Chloride (43%), $1440.00/dry ton, plus applicable sales tax, and not to exceed $173,448.00. d. USALCO for Aluminum Chlorohydrate, $0.47/pound, and not to exceed$105,750.00. e. SNF/Polydyne Inc. for C-6288 Polymer or equivalent, $16.847/gallon, and not to exceed $31,840.83. f. SNF/Polydyne Inc. for WE-2273 Polymer or equivalent, $17.045/gallon, and not to exceed $443,170.00. Under the power and authority conferred upon this Council by the Charter of said City.
