4401 `RESOLUTION NO. 633;0 N.C. S.. RESOLUTION OF THE COUNCIL OF THE: CITY OF PETALUMA DECLARING CANVASS OF RETURNS AND RESULTS OF REGU- LAR MUNICIPAL ELECTION INTRODUCED BY COUNCILMAN' SECONDED BY COUNCILMAN . -19E: WHEREAS, by proceedings heretofore duly had and taken, the Regular Municipal, Election was held in the City` of Petaluma (herein- after called the "City" ) on. June 12 , 1973 ; and WHEREAS, said Regular Municipal Election was held on said . date in accordance with law, and the votes thereat received and can- vassed, and the returns thereof ascertained, determined and declared in all respects as required by law; NOW, THEREFORE., BE IT RESOLVED, by the. Council of the City of - Petaluma as 'follows:: (1) The City Clerk of the City be,, and she is, hereby in- structed to enter this resolution on the minutes of this Council as a statement of the result of said election. (2) The total number of ballots cast in the City at said Regular Municipal Election was ,5,64,9 ballots; 1„434 ballots were cast outside. the City, and 37 ballots were spoiled' and not counted, for a total of 7, 083 ballots. All pUblic improvements and easements shown on the Tentative -Map :will be subject to future, review when the improvement plans are submitted to: the City for approval, 2 . The subdivider- shall be required to design. and, construct the bridge structures across the :Washington Creek flood control channel on the extension of McKenzie Ave, and McGregor Ave. at the -dreek juncture.. 13. The Final Map and development shall be geared to the incremental phasing of the residential units, approved for construction by the 'City Council ' s r resid'ential development control ,allotment system. An allotment of. multi-family units 'was; approved by the Council for the 1973-74 con- struction year. 14 . The -subdivider shall be required; to enter into an agreement with the City of Petaluma fo"r the right-of-way ,and improvements on the extension of Park Lane, and McGregor Ave. southerly from. Park Lane as shown on Exhibit "A" of the Tentative 'Map. 15. A complete landscaping plan and grading plan shall b.e ,submitted, together with the improvement plans for each incremental unit of the Tentative 'Map to be °constructed, for final approval by the Department of Community Development. 16 . Prior to the approval,of any subdivision, units of the development (Final Subdivision Maps) a P.U.D. (Planned Unit Development) shall be approved and adopted by the City Council,. 17. There shall be, a width sufficient for a l=inear park along Washington Creek to be determined by the City Council according to the advice -Of. the Parks ie Recreation Committee. No 2 was .discussed in relationship to the conditions of approval of th'e Tentative Map. The folloting points should be considered in dealing with this matter,. General Considerations : 1. Condition No.- ,17 of the conditions of approval of the Tentative Map for Greenbrier Unit Nod 2 ,as approved by the Planning Commission s tates, "there shall, .be a width sufficient for a linear park along Washington Creek to be determined by the City Council according to the advice of the Parks 'and Recreation Committee. " 2 . The Recreation,, Music and Parks Commission in their meeting on June .13, 1973 recommended,. that ''"'a 30 ' wide linear park as indicated on the E.D.P. ,be dedicated by Qantas Development; along the eastern property line, continuing along the Washington Creek , which will include meandering ,pedestrian paths and separated bicycle lanes , and landscaping_ CA precise. development plan shall be submitted by the developer to the Recreation Commission , the Planning Commission and the City Council for approval;: and, construction of these facilities shall occur before acceptance by the City. " .3:... The Environmental Design Plan shows a linear park along Washington Creek. 4.. The Staff Report to the Residential. Development Evaluation Board dated October 24 , 1972. 'indicated concern over the lack of provisions for hiking and bicycle trails along Washington Creek. 5 . Minutes of the Residential Development Evaluation Board' s meeting of November 11, 1972 indicated that Mr,, Jon Joslyn, representing Qantas Development Corporation, .sta"ted that no bike trails were pro- posed. along the Creek because of, a possible traffic hazard along the bridges. He added that the developer was willing to discuss possible areas for, bike trails and expressed a desire to work with the Sonoma County Flood Control Agency to turn its 10 ' creek channel , usually paved in concrete , into bike' trails. 6 . A 10 ' • landscaped easement has been dedicated along Washington Creek from East Washington. Street to the Qantas property behind the Washington Square Shopping Center. 7. The 'Sonoma County Water 'Agenby indicates that gates could be opened up for trails use along the north side. of the channel (opposite the subject ;property) from Ely Road to McKenzie Avenue at such time as ' • the channel crossing is constructed. • S 'Addeniun Report for Qantas Tentative Map on Linear Park along Washington Creek in Greenbriar„Unit No. 2,, June :1&, 1973 8,. The S'onoma. County Water. Agency has control of a strip of land which is approximately 9 ' wide len the Qantas side of the Channel.. This land would normally be used' by the Agency to construct 'a cutoff ditch, and the remainder would be landscaped!. However, the Agency has advised us that much of, this land has eroded, and this 9 ' strip may be needed to restructure the bank. Therefore , this property cannot be made available for recreationa l uses. 9.. The Recreation Commission has indicated that the 30 ' width is desirable to accommodate 10 ' wide bicycle path and a separate 4 ' wide hiking trail with landscaping on either side. Recommendation: In view of the designation of a. linear park along Washington Creek in the Environmental ' Design Plan,, and in view of the several references to said park made during the proceedings of the Residential Development Evaluation Board, the staff recommends that this park be ,developed in accordance with the aforementioned recommendations: of the Recreation, Music and Parks Commission. COMMENTS & .RECOMMENDATIONS REGARDING "STREETS" The bridges across' the Sonoma County Water Agency channel at Maria Drive (McKenzie) and McGregor Avenue must be constructed by the subdivider.. The City presently holds funds in trust contributed by previous developers on the northside of the channel that are held for the purpose of defraying a portion of this subdivider' s costs in constructing the bridges . The trust funds originally represented 1/2 the estimated cost of the bridges , however, inflation in the intervening years has no doubt taken its < toll. 0 With regard to the public street improvements upon and bordering the City of Petaluma Park property, the sub- divider should contact the City Manager" and work out an agreement for the right-of-way and improvements on the extension of Park lane and McGregor, southerly from Park Lane. Although unit boundaries are not shown, it is my understanding, from previous conversations With the subdivider, that unit phasing is • planned. - Park Lane and McGregor Avenue from Park Lane southerly should be constructed under the initial unit of this development whether this first -unit is the P.U.D. along McKenzie or the single family residences along McGregor,. ' 1. COMMENTS & RECOMMENDATIONS REGARDING "DRAINAGE" • The existing pipe drainage system offsite and downstream southerly from the proposed development has a limited hydraulic capacity. A sufficient acreage of the proposed development must be back drained to the Sonoma County Water •Agency drainage channel in order to guarantee that the existing downstream offsite drainage system will not be overloaded; i . ec , the developer' s engineer must submit hydraulic caldUlations to the Sonoma County Water Agency and the City Engineer proving that the proposed drainage design does not overload the existing offsite downstream drainage system. Section 22. 4, 617 of the Subdivision Ordinance requires any proposed drainage easements to be shown on the tentative map. The easements for the public owned and maintained portion of the drainage system, back draining to the Sonoma . County Water Agency channel northwest of McKenzie should be shown on the tentative map. The privately owned and maintained portion of the drainage system should be shown as such on the tentative map. GRADING PLAN The tentative map , as submitted by the developer, does not contain a grading plan which is required under Sectiod 22.4. 610 of the Subdivision Ordinance. Director prepare a written report on the conformity of the Tentative 'Map to the provisions of the General Plan, the Environmental Design Plan, the Zoning Ordinance, and all other applicable requirements of this and all other ordinances and regulations of the City of Petaluma, in keeping with ordinance requirements , the City of Petaluma Subdivision Committee met with the developer, Qantas Development Corporation, and dis- cussed the submittal of a? preliminary map.; As a result of that meeting, many items were discussed which have been either incorporated into the Tentative Map or are proposed: as conditions of approval of the Tentative Map.
