2 RESOLUTION UPHOLDING APPEAL OF SITE PLAN AND ARCHITECTURAL
3 REVIEW COMMITTEE APPROVAL OF FOUNDRY WHARF PARKING LOT
4 DESIGN (TERMINUS OF SECOND STREET)

6 WHEREAS, Walter Haake, owner/developer of Foundry Wharf Business Park requested
7 approval of a parking lot to be constructed at the southern terminus of Second Street, a
8 portion of Assessor's Parcel Number 008-194-31; and
9
10 WHEREAS, the Site Plan and Architectural Review Committee (SPARC) considered the
11 application during the meeting of February 8, 1990, at which time the parking lot design
12 was conditionally approved; and
13
14 WHEREAS, Mr. Joseph Durney, the owner of an adjacent property at 618, 620 and 622
15 Second Street (Assessor's Parcel Number 008-194-11) appealed the decision of SPARC in
16 accordance with applicable provisions of the Zoning Ordinance (No. 1072 N.C.S.); and

18 WHEREAS, the appeal was considered by the City Council on April 16, 1990 during which
19 time public testimony was heard and considered prior to the Council rendering its decision;
20
21 NOW, THEREFORE, BE IT RESOLVED that the City Council finds as follows:
22 1. That the appellant has supplied recorded documents that appear to substantiate
23 claims of existing easements across the Haake property to the Durney property.
24 2. That title research pursued by the developer confirms the existence of .said
25 easements.
26 BE IT FURTHER RESOLVED that the parking lot shall be redesigned to retain the
27 access in front of the Durney property as prescribed in the easements.

29 BE IT FURTHER RESOLVED that the City Council of the City of Petaluma upholds the
30 appeal of Joseph Durney, thereby reversing the decision of the SPARC Committee.
31 Under the power and authority conferred upon this Council by the Charter of said City.
