FELIX OF THE SITE PLAN AND ARCHITECTURAL REVIEW COMMITTEE (SPARC) ACTION ON THE PETALUMA PLAZA SOUTH SHOPPING CENTER EXPANSION FOR A ROSS STORE (A.P. N0.007-340-06, 07 AND 08) WHEREAS, on March 29, 1990, Site Plan and Architectural Review Committee approval was conditionally granted to approve a 23,000 square foot addition to an existing shopping center; and WHEREAS, an appeal of the Site Plan and Architectural Review Committee's conditions of approval was appropriately filed on Apri12, 1990 by Stanley M. Felix; and WHEREAS, the City Council has held a public hearing on April 16, 1990 to consider this appeal and has considered all reports, plans, and testimony presented at this meeting; 20 NOW, THEREFORE BE IT RESOLVED that the City Council finds that because the 21 applicant has agreed to certain conditions, certain SPARC requirements are not necessary; 22 and 23 24 BE IT FURTHER RESOLVED that the City Council hereby upholds the appeal of 25 Stanley M. Felix, modifying the conditions of approval adopted by the Site Plan and 26 Architectural Review Committee as follows: 27 28 Project Specific Conditions: 29 1. This permit shall allow a 22,730 square foot addition to an existing shopping center. 30 The addition may be phased as applied for by the applicant to allow 15,280 square 31 feet in phase I and 7,450 square feet in phase II. 32 33 ~ 2. The following requirements of the Engineering Department shall be met prior to 34 the issuance of a building permit, subject to the approval of the City Engineer: 35 a. Major Traffic Facilities Improvement Fees: The project sponsor shall pay a 36 fee of $50.00 per daily trip end estimated to be generated by said project. If 37 the City establishes a Major Facilities Traffic Mitigation fee prior to issuance 38 of a building permit, the fee for said project shall thereinafter be either 39 $50.00 per trip end or the major facilities traffic mitigation fee, if in effect at 90-128 N.C.S. The City Engineer has determined the fee to be $28,200 presently. b. The project shall pay its fair share of traffic signal modifications to the McDowell Boulevard at East Washington intersection. The project share is $961.00. 3. The following additional conditions of the Engineering Department shall be met, subject to City Engineer approval: a. All existing utilities (e.g. sanitary sewer, water main, fire hydrants, and storm drain) as shown on the as-built plan for Petaluma Plaza Shopping Center (photocopy attached) shall not be located under any building structures. If utility relocation is necessary to accommodate the proposed structure, a plan showing these relocations designed by a registered Civil Engineer shall be submitted for review and approval prior to issuance of a building permit. All utility relocation shall be accomplished as required by the City Engineer.. b. A title report shall be required stating all existing easements and deed restrictions. This report shall be submitted to the Engineering Department at the time the utility relocation plan is submitted. c. Pacific Telephone, PG&E, and Viacom shall be contacted regarding their underground utilities adjacent to the project area, prior to the issuance of a building permit. The requirements of the above agencies regarding any relocation of easements or equipment shall be complied with. 4. The following requirements of the Fire Marshal shall be met: a. Fire hydrant or fire service mains shall not run under buildings as per Section 3-8.1 N.F.P.A. Codes 1988 Edition. b. Existing hydrant shall be maintained at present existing location. c. Provide Fire Hydrants as required by the Fire Marshal's office. One (1) fire hydrant is required for project. Provide protection around hydrant. d. Provide fire extinguisher 2 A rated A B C dry chemical type as required by the Fire Marshal. e. Post address at or near main entry door, minimum two inch letters. f. Provide signs over exit doors stating, "This door to remain unlocked during business hours". Letters shall not be less than 1 inch high. 90-128 N.C.S. 2 1 g. Any building or portion of a building used for high pile storage shall conform 2 to Article 81 of the 1985 edition of the Uniform. Fire Code, including smoke 3 removal, venting, and Fire Department access to building. 4 h. Storage shall be maintained a minimum of eighteen (18) inches below 5 sprinkler heads. 6 i. Provide KNOX box for key control located on building as required by the 7 Fire Marshal. 8 j. Provide key with tag indicating address and .suite number for KNOX box. 9 k. Provide electrical conduit from post indicator valve to alarm panel location 10 for tamper switch as underground is being installed. 11 1. Check valve in Fire Department connection to be installed above grade. 12 m. Barricades shall be provided to protect gas meters from vehicular traffic 13 impact. 14 n. Two inch clearances shall be provided around fire sprinkler lateral and riser 15 at foundation and floor slab. 16 0. All emergency lighting, exit lights, shall have two separate sources of power 17 as required in the Building Code. 5. The following requirements of the Police Department .shall be complied with, subject to Police Department review and approval: a. On the front door of the business, the address should be visible from the street with 2-3 inch letters. b. There should be a motion detector type lighting at the. rear loading area of the store. c. The name of the business as well as the address should also be placed on the rear door of the business. d. The placement of the cashier's should, if possible, be visible from the street area through the window for the passing officer. 6. Revised elevations shall be submitted for staff review and approval prior to the issuance of a building permit which meet the following requirements: a. The reveals shown on the these elevations, as well as on the front elevations, shall be true reveals providing actual physical relief through recessing or extension. b. The "columns" on the south and west elevations shall be actually physically recessed or extended outward. 90-128 N.C.S. 3 1 2 7. A landscape plan shall be submitted for staff review and approval, prior to the 3 issuance of a building permit. The plan shall include the size, location, spacing and 4 number of all plantings and irrigation plan. Landscaping shall be installed prior to 5 final occupancy. The landscape plan shall address the following requirements: 6 a. Twenty (20) trees of a 15 gallon size shall be planted, evenly spaced, along 7 the edge of the Caltrans right-of-way. 8 b. A row of five (5) gallon oleander shall be planted evenly spaced to the rear, 9 from the Thrifty Store to Phase 1 of the- Ross Store. 10 11 8. A revised sign program for the addition shall be submitted for staff review and 12 approval prior to the issuance of any sign permits. Signs for the addition shall 13 comply with the following requirements: 14 a. Total sign area for the addition shall not exceed 319 square feet. 15 b. The sign on the west elevation is not permitted under zoning ordinance 16 section 26.911-A regulating freeway oriented signs. 17 18 9. Prior to the issuance of a building permit, plans shall be submitted to address the 19 following requirements. The proposed improvements shall be completed prior to 20 the issuance of a certificate of occupancy. 21 a. All new roof top equipment shall be screened from view from the parking lot 22 of the shopping center and from East Washington Street and Highway 101. 23 b. The site area in the rear of the buildings backing onto both East Washington 24 and Highway 101 shall be "cleaned up" through the following actions: 25 1. Trash enclosures shall be provided for all dumpsters, designed to 26 meet city design criteria. 27 2. No outdoor storage of pallets, boxes, equipment, etc. shall be 28 permitted unless screened from view to staff s satisfaction. 29 3. No open sign cans shall be permitted. 30 4. Exterior (front and rear) facades for the entire center shall be 31 repainted with a cohesive color scheme as necessary to achieve 32 uniform colors on walls within two years following completion of the 33 Ross Store. 34 90-128 N.C.S. 4 1 10. This project shall be responsible for the payment of the following fees prior to the 2 issuance of building permit: Community Facilities Development Fee and School 3 Mitigation Fee. Standard SPARC Conditions 11. All trees shall be a minimum fifteen gallon size (i.e. trunk diameter of at least 3/4 inch measured one foot above the ground) and double staked; all shrubs shall be five gallon size. All landscaped areas not improved with lawn shall be protected with atwo-inch deep bark mulch as a temporary measure until the ground cover is established. 12. All new plant material shall be served by a City approved automatic underground irrigation system. 13. All planting shall be maintained in good growing condition. Such maintenance shall include, where appropriate, pruning, mowing, weeding, cleaning of debris and trash, fertilizing and regular watering. Whenever .necessary, planting shall be replaced with other plant materials to insure continued compliance with applicable landscaping requirements. Required irrigation systems shall be fully maintained in sound operating condition with heads periodically cleaned and replaced when missing to insure continued regular watering of landscape areas, and health and vitality of landscape materials. 14. Root barrier systems shall be utilized for trees near streets or walkways as needed, subject to staff review and approval. 15. All improvements and grading shall comply with the Sonoma County Water Agency's Design Criteria. 16. Applicant shall participate on a fair share basis in any future assessment districts or other funding mechanisms formed to improve area-wide flooding, traffic congestion or other subregional problems for which development of this property is found to be a contributing factor. 17. All work within a public right-of-way requires an excavation permit from the Department of Public Works. 90-128 N.C.S. 5 18. Construction activities shall comply with applicable zoning ordinance and municipal code performance standards (noise, dust, odor, etc.). l9. A separate water meter shall be provided for landscape ..irrigation systems or as required by staff. 20. In the event that archaeological remains are encountered during grading, work shall be halted temporarily and a qualified archaeologist shall be consulted for evaluation of the artifacts and to recommend future action. The local Indian community shall also be notified and consulted in the event any archaeological remains are uncovered. 21. Any future color schemes that vary from those approved shall be subject to SPARC review. 22. External downspouts shall be painted to match background building colors. Scuppers without drainage pipes may not be installed because of probable staining of walls (overflow scuppers are excepted). 23. All outdoor mechanical equipment, satellite dishes, fire main and all rooftop equipment shall be fully visually screened upon installation subject to the approval of the Community Development Department. Screening devices shall be shown on construction and/or landscape plans. 24. All new exterior light fixtures shall be shown on plans subject to staff review and approval. All lights attached to buildings shall provide a soft "wash" of light against the wall. All lights shall conform to City performance standards (e.g. no direct glare, no poles in excess of 20 feet height, etc.) and shall compliment building architecture. 25. Trash enclosure screens shall be protected from vehicular movements with minimum three foot wide curbed landscape buffers, and shall be designed to conform with all specification of the City Trash Enclosure Screen Design Standards. 90-128 N.C.S. 6 1 26. 2 3 4 5 6 7 8 All new driveway or parking surface areas shall be improved with a City approved surface of asphaltic-concrete or concrete pavement. All new parking surfaces shall be bordered with concrete curbing which is designed to meet at least the minimum specifications of the City Parking Design Standards.
