S BETWEEN ADOBE CREEK AND LAKEVILLE SQUARE APARTMENTS, 6 AP N0.017-040-SO 7 8 9 WHEREAS, the Planning Commission has recommended issuance of a Mitigated Negative 10 Declaration pursuant to the California Environmental Quality Act (CEQA) for a proposal 11 to create a 41-lot residential subdivision on Ely Boulevard between Adobe Creek and 12 Lakeville Square Apartments; and 13 14 WHEREAS, an initial study which noted potential traffic, noise, and grading impacts as 1S well as impacts to the fish spawning and creek habitat in Adobe Creek has been prepared 16 for the project by the Community Development Department; and 17 18 WHEREAS, the results of this study have indicated that conditional approval of this 19 project will not trigger any significant adverse environmental impacts; and 20 21 WHEREAS, staff and the Planning Commission have recommended that a mitigated 22 negative declaration be issued on the above project; 23 24 NOW, THEREFORE, BE IT RESOLVED that the issuance of said Mitigated Negative 2S Declaration pursuant to the California Environmental Quality Act is hereby approved, 26 based upon the following findings: 27 28 1. The project, as conditionally approved, does not have the potential to degrade the 29 quality of the environment, substantially reduce the habitat of a fish or wildlife 30 species, cause a fish or wildlife population to drop below self-sustaining levels, 31 threaten to eliminate a plant or animal community, reduce the habitat of a fish or 32 wildlife species, cause a fish or wildlife population to drop below self-sustaining 33 levels, threaten to eliminate a plant or animal community, reduce the number or 34 restrict the range of a rare or endangered plant or animal or eliminate important 3S examples of the major periods of California history or prehistory. 36 37 2. The project, as conditionally approved, does not have environmental effects which will cause substantial adverse effects on human beings, either directly or indirectly. 5.
