2 RESOLUTION APPROVING THE VESTING TENTATIVE SUBDIVISION
3 MAP .FOR MCNEAR HILL SUBDIVISION, A 186-LOT
4 TOWNHOUSE CONDOMINIUM PROJECT LOCATED ON
5 PETALUMA BOULEVARD SOUTH (ACROSS FROM MCNEAR
6 AVENUE), AP N0.008-530-04

8 WHEREAS, Walter Kieckhefer has filed with this Council a Vesting Tentative Map to
9 subdivide land within this City to be known as McNear Hill, and has paid all required filing
10 fees; and
11
12 WHEREAS, the City Engineer, the Community Development Director, and the Planning
13 Commission have examined and reviewed the same as required by law and all reports,
14 recommendations, and comments thereon have been forwarded to and considered by this
15 Council at its meeting held on January 9, 1990.

17 THEREFORE, BE IT RESOLVED that this Council hereby finds for the Vesting
18 Tentative Map as follows:

20 Findings
21 1. No additional environmental review is necessary for this project as per CEQA
22 Section 15162.
23 2. This project, as conditioned, is consistent with the City of Petaluma General Plan.
24 3. This project, as conditioned, is consistent with the City of Petaluma Zoning
25 Ordinance and the PUD district.
26 4. This project represents a more desirable land use than possible within an individual
27 zoning district and meets the required findings of Section 19A-300 of the zoning
28 ordinance.
29 5. This project, as conditioned, is consistent with the State Subdivision Map Act and
30 the City of Petaluma Zoning Ordinance.

32 BE IT FURTHER RESOLVED, based on the findings set forth above, that the above-
33 referred to Vesting Tentative Map, be and the same is hereby approved, subject to the
34 conditions set forth below and incorporated herein as follows:

36 Conditions:
37 1. The following requirements of the City Engineer shall be met, subject to his. review
38 and approval:

1 a. All proposed grading, proposed and relocated public and private utilities
2 (sanitary sewer, water main and storm drain) to be installed to serve this
3 development shall require review and approval by the appropriate City
4 department. This submittal shall be in accordance with the City's minimum
5 design criteria.
6 2. Prior to filing an application for a final map, this tentative map shall be subject to
7 review and approval of the City of Petaluma Site Plan and Architectural Review
8 Committee.
9 3. As required by the Subdivision Map Act, "any public access route or routes and any
10 easements along the bank of a public waterway river shall be expressly designated
11 on the tentative and final map, and such map shall expressly designate the
12 governmental entity to which such route is dedicated and its acceptance of such
13 dedication.
14 4. All conditions set forth in Resolution 86-223 and in Resolution 88-224 shall remain
15 in effect for the approval of this development plan and as stated in P~JD Unit
16 Development Plan Condition No. 1 shall be complied with as set forth therein,
17 unless amended by the conditions of this project approval, subject to review and
18 approval by City staff.
19 5. This map supersedes any and. all previously approved Vesting Tentative Maps or
20 Tentative Maps affecting this site.
