HomeMy WebLinkAboutResolution 90-136 04/30/1990-t _} Resolution No. 90-136 N~.s. of the City of Petaluma, California 1 2 RESOLUTION APPROVING THE TENTATIVE SUBDIVISION MAP 3 FOR FAIRWAY MEADOWS, A 41-LOT RESIDENTIAL 4 SUBDIVISION LOCATED ON ELY BOULEVARD BETWEEN 5 ADOBE CREEK AND LAKEVILLE SQUARE APARTMENTS, 6 AP N0.017-040-50 7 8 WHEREAS, Duffel Financial and Construction Company, as owner, has filed with this 9 Council a Tentative Map to subdivide land within this City to be known as Fairway 10 Meadows Subdivision,. and has paid all required filing fees; and 11 12 WHEREAS, the City Engineer, the Director of Community Development, and the. 13 Planning Commission have examined and reviewed the same as .required by law and all 14 reports, recommendations, and comments thereon have been forwarded to and considered 15 by this Council at its meeting held on April 16, 1990; and 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 NOW, THEREFORE, BE IT RESOLVED that this Council hereby finds for the Tentative Map as follows: Tentative Map Findings: 1. The proposed subdivision, as conditionally approved, together with provisions for its design and improvement, is consistent with the General Plan objectives, policies, general land uses and programs. 2. The site is physically suitable for the type and density of development proposed, as conditionally approved. 3. The design of the subdivision and the proposed improvements therefore, as conditionally approved, will not cause substantial ,environmental damage, and no substantial or avoidable injury will occur to fish or wildlife or their habitat. 4. The design of the subdivision and the type of improvements will not cause serious public health problems. 5. The design of the subdivision and the type of improvements proposed will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision. 6. The discharge of waste from the proposed subdivision into the existing community sewer system will not result in violation of the existing requirements prescribed by the Regional Water Quality Control Board. N.C.S. :` 1 BE IT FURTHER RESOLVED, based on the findings set forth above, that the above 2 referred-to Tentative Map, be and the same are hereby approved, subject to the conditions 3 set forth below and incorporated. herein as follows: 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 Tentative Map Conditions: 1. The subdivider shall comply with the following requirements of the City Engineer: a. The developer shall participate in a fair-share contribution for off-site intersection signalization for Casa Grande Road/Ely Blvd. South; Frates Road/Ely Blvd. South; and Casa Grande Road/South McDowell Blvd. prior to approval of the final map for this development. Actual amounts to be determined by the City Engineer. b. This project shall comply with all applicable flood mitigation requirements adopted. by the City Council as contained in Zoning Ordinance Article 16 and Municipal Code, Chapter 17.30 "Storm Drainage Impact Fee". All improvements and grading for natural waterways with provisions to accommodate flood flows. c. The public sanitary sewer located adjacent to Lots 40 and 41 shall be located in an exclusive 10' paved easement with adequate access provided far maintenance of this proposed main. Installation of fences shall be avoided across this easement. d. All street lights within this development shall be standard metal fixtures and dedicated to the City for ownership and maintenance. Prior to City acceptance, the developer shall verify all lights meet PG&E's LS2 rating system. e. All grading and erosion control measures shall conform to the City's Erosion Control Ordinance No. 1576 N.C.S. f. This development proposes to connect to the existing sanitary sewer located adjacent to the rear property corner of Lots 40 and 41. Prior to approval of the final map, developer's engineer shall verify if this existing sewer has been dedicated to the City. If it has not, this development shall acquire a 10' exclusive easement in favor of the City or an alternate design to sewer this property shall be required. g. In accordance with the PMC Section 20.28.020 "access to public streets -all lots or parcels created by the subdivision of land shall have access to a public street improvement to standards hereinafter required". Therefore, access to Lots 1, 2 and 3 shall be via Fair Way. Reso. 90-136 N.C.S. 2 ;, 1 h. A minimum of four fire hydrants shall be installed to Fire Marshal 2 specifications with locations to be approved prior to Final Map approval. 3 i. The street section for Meadow Loop shall be redesigned to ref lect a width of 32' 4 measured face of curb to face of curb, permitting two 9' travel lanes and two 7' 5 parking lanes. Sidewalk shall be installed along both sides of the street behind a 6 minimum four foot wide street tree planter strip, and where determined necessart 7 by City staff, situated within a public access easement on private property. 8 Sidewalk shall be eliminated around the cul-de-sac bulb, the diameter of the 9 bulb enlarged to 100 feet, and a parking island installed to accommodate 10 landscape islands and six parking spaces. 11 2. The subdivider shall comply with the following Pacific Bell requirements: 12 a. We request a ten foot P.U.E, on all streets within and bordering this 13 subdivision. 14 b. A joint P.U.E. will be required on an "as built" basis when PG&E and Pacific 15 Bell facilities are constructed within this subdivision. 16 c. Any rearrangement of telephone facilities that conflict with the development 17 of this subdivision will be at the developer's expense. 18 d. When developer cancels, modifies or defers its request for facilities, 19 developer shall pay a charge which will allow Pacific Bell to recover the 20 nonrecoverable cost of its engineering, labor; material, equipment and other 21 related expenses as a result of the work performed by Pacific Bell to comply 22 with developer's request. Per C.P.U.C. Rates and Tariffs -Revision A2, 23 Rules 15 and 16. 24 e. Changes made to the map should be resubmitted for our review. 25 3. The Tentative Map shall be amended prior to submittal for Final Map to reflect all 26 applicable modifications required under the PUD Conditions of Approval. Said 27 map amendment shall meet specifications of the City Engineer and Director of 28 Community Development and shall also incorporate any SPARC conditions of 29 approval pertinent to the map. 30 4. The following Special Development Fees shall be applicable to this project: Water 31 and Sewer Connection, Community Facilities, Storm Drainage Impact; Park and 32 Recreation Land Improvement, and School Impact. 33 5. The project sponsor shall execute a binding agreement which shall stipulate that 34 upon close of escrow of each residential dwelling unit in Fairway meadows, 35 developer shall pay $150.00 to the City per daily trip end estimated to be generated 36 by said unit. Each unit is estimated to generate 10.0 trip ends per day. If the City Reso. 90-136 N.C.S. 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 establishes a Major Facilities Traffic Mitigation Fee prior to close of escrow of any unit(s), the fee for said units(s) and all subsequent units in this project thereafter will be either $150.00 per trip end or the Major Facilities Traffic Mitigation Fee, whichever is in effect at time of issuance of building permits. 6. The project sponsor shall be required to pay low and moderate income housing in- lieu fees of an amount to be determined according to the schedule established by the City Council, or make alternative arrangements to meet the low and moderate income housing provision requirements of the Housing Element, subject to approval of the City and prior to approval of the Final Map. 7. The proposed storm drain improvements shall be modified as determined by Engineering staff to prevent discharge of potentially harmful substances into the creek waters upstream of the spawning area. 8. Any labeling errors or other erroneous information appearing on the map development or landscape plan shall be corrected prior to Final Map approval.
