HomeMy WebLinkAboutResolution 2008-148 N.C.S. 08/04/2008~Zesolution No. 2008-148 N.C.S. of the City of Petaluma, California AUTHORIZING THE CITY MANAGER TO ENTER INTO A REVOCABLE LICENSE AGREEMENT WITH SONOMA MARIN AREA RAIL TRANSIT (SMART) REGARDING PHASE 3 OF THE PETALUMA RIVER TRAIL PRO.IECT N®. C200503 WHEREAS, the City desires to construct a pathway along the Petaluma River from Washington Street to the Lakeville Street Bridge, which crosses two SMART properties; and, WHEREAS, agreements to construct the pathway on SMART properties is required; and, WHEREAS, staff has negotiated two revocable license agreements with SMART for a one-time-only fee of $1200 ($600 each); and, WHEREAS, SMART has indicated that they will grant the revocable license agreement to the City for the construction of the pathway. NOW, THEREFORE, BE IT RESOLVED that the Petaluma City Council hereby authorizes and directs the City Manager to enter into two revocable license agreements with SMART on behalf of the City of Petaluma for the right to construct a pathway on two SMART properties as part the Petaluma River Trail Project No. C200503.
