RESOLUTION APPROVING AGREEMENT
FOR ENGINEERING SERVICES
NORTH MCDOWELL BOULEVARD ASSESSMENT DISTRICT NO. 17
CITY OF PETALUMA, COUNTY OF SONOMA, STATE OF CALIFORNIA.
The City Council of the City of Petaluma resolves:
This City Council approves that certain agreement between
the City of Petaluma, and Nystrom Engineering Corp., for services
as Engineer of Work for North McDowell Boulevard Assessment
District No. 17, City of Petaluma, County of Sonoma, California,
dated the 30th day of April, 1990, and attached to this resolution.
The Mayor is authorized to sign the agreement and the
City Clerk is authorized to attest its execution.
Under the power and authority conferred upon this Council by the Charter of said City.

AGREEMENT FOR ENGINEERING SERVICES
NORTH MCDOWELL BOULEVARD.ASSESSMENT DISTRICT NO. 17
This is an agreement for engineering services between the
CITY OF PETALUMA, a municipal corporation of the State of
California, referred to as Client, and NYSTROM ENGINEERING CORP.,
referred to as Engineer.
1. Client retains Engineer as Engineer of Work for North
McDowell Boulevard Assessment District No. 17, City of Petaluma,
County of Sonoma, California, to perform the following services:
(a) Consult with City officials (and key property owners) to
determine baekgr.ound of formation 'of North McDowell
Boulevard Assessment District No. 17 and various interests
and goals of all parties.
(b) Assist in preparation of petitions.
(c) Prepare (or review) Boundary Map.
(d) Assemble property ownership records and City zoning and
land use plans and ordinances.
(e) Consult with City and. Design Engineering Consultant
regarding alternate bases of benefit for proposed
assessments.
(f) Prepare preliminary assessment district cost estimate.
(g) Calculate preliminary spread o'f assessments.
(h) Prepare preliminary Assessment Roll.
() Prepare Assessment Diagram.
(j) Prepare and submit to City the preliminary. Engineer's
Report.
(k) Assist City and Bond Counsel in preparation of various
resolutions for presentation to City Council.
(1) Prepare revised assessment district cost estimate based on
Construction Bias.
(m) Calculate~revsed spread of assessments.
(n) Prepare Amended Assessment Roll and Engineer°s Report.
(o) Present Amended'Engineer0s Report to City Council for
.Public Hearing.
(p) During entire process, continued- consultation with Director
of .Public Works and Bond Counsel (and key property owners
to the extent desired).
(q) Attendance and representation;at meetings of property
owners, 'City staff, and City Council.
2. In consideration of the services set forth in
Paragraph 1, Client shall pay to Engineer the following fee and
costs:

In no event, however, will the compensation of Engineer
exceed the amount set forth by Engineer for that purpose in the
Report, or any amended Report, prepared by him under Section~10204
of the Streets and Highways Code, without specific authorization of
the legislative body.
Payment by Client of said compensation is contingent upon
the levy of assessments and the sale and delivery of improvement
bonds representing unpaid assessments in the assessment district.
If, for any reason.., assessments are not confirmed and bonds
delivered, Engineer shall be paid $15,000.00. Engineer's

compensation is payable upon delivery of the bonds, or, if no
assessments are levied, upon abandonment of the project.
