HomeMy WebLinkAboutResolution 90-165 05/21/1990 FZesoluti®n N®. 90-165 N C.S. of the City of Petaluma, California 1 2 GRANTING 1991 ALLOCATIONS 3 4 WHEREAS, the City Council has adopted a growth management system by Ordinance 5 1716 N.C.S. (Chapter 17.26 of the Petaluma Municipal Code) establishing the procedure 6 for granting the allocation pool on a yearly basis; and 7 8 WHEREAS, interested developers have filed Notice of Intent to Develop forms in 9 accordance with the provisions of Chapter 17.26 and these, in combination with other 10 allocation obligations created and anticipated by the action of the City Council, comprise 11 the total number of allocation requests for 1991; and 12 13 WHEREAS, the granting of allocations must be done in conformance with General Plan 14 policy that permits an annual average of 500 allocations, no more than 1,000 allocations in 15 any year and no more than 1,500 allocations over three consecutive years; and 16 17 WHEREAS, the City Council wished to investigate alternative. ways in which the Village at 18 Southpoint proposal by Stephens Properties could proceed the Council continued 19 discussion of the Village at Southpoint proposal to April 30, 1990, and at which time the 20 Council decided not to grant the Village at Southpoint 1991 allocations; and 21 22 WHEREAS, the City Council finds the granting of allocations is not a project pursuant to 23 Section 1578 of the California Environmental Quality Act and, therefore, no environmental 24 action is necessary at this time. 25 26 NOW, THEREFORE, BE IT RESOLVED that the City Council grants the 1991 27 allocations as described below based on findings described below: 28 1. 300 allocations to the Corona/Ely Specific Plan area. 29 2. 100 allocations to Yashima Construction for Adobe Creek Subdivision. 30 3. 33 allocations to Young America Homes for Park Place V Subdivision. 31 4. 22 allocations to James Revoir for Oakview Estates. 32 5. 45 allocations for in-fill projects. 33 34 BE IT FURTHER RESOLVED that the City Council makes the following findings in 35 support of its granting the 1991 allocations: 36 37 Reso. 90-165 N.C.S. The number of available 1991 allotments is consistent with the provisions of the 4 Residential Growth Management System Ordinance (Chapter 17.26 of the 5 Petaluma Municipal Code) and the applicable policies of the 1987-2005 Petaluma 6 General Plan. 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 2. The City Council has considered 1991 Development Objectives as well as other allotment commitments in determining which projects would receive 1991 allotments. 3. The decision to grant 1991 allocations as specified herein is not detrimental to the public health, safety or welfare because the City Council has considered the applications for 1991 allocations in the context of overall City-wide growth rates, adequacy of public facilities and the timing of development. 4. The City Council has chosen to grant 45 - 1991 allocations to in-fill projects pursuant to the Residential Growth Management System Ordinance, Section 17.26- 060(c) Award of Allotments. 5. The City Council grants 22 - 1991 discretionary allocations to James Revoir for Oakview Estates due to their proposal being the only application representing a project that cannot be developed as an infill project on the westside, 1991- Development Objective #2. 6. The City Council grants 300 - 1991 allocations to Corona/Ely Specific Plan area and 100 - 1991 allocations to Adobe Creek Subdivision per development agreement. 7. The City Council grants 33 - 1991 allocations to Park Place V per reservations for 30 allocations, plus 3 additional to enable the project to maximize its density as permitted by the General Plan Land Use Map. aloc / council2 Under the power and authority conferred upon this Council by the Charter of said City.
