4 EYCESS RIGHT-OF-WAY WITHIN PETALUMA
5 AUTO CENTER OFF INDUSTRIAL AVE.
6 IN THE CITY OF PETALUMA, CALIFORNIA
7 A~TORE PARTICULARLY DESCRIBED IN THE
8 BODY OF THIS RESOLUTION

11 BB IT RESOLVED that the City Council of said City of
12 Petaluma does hereby declare its intention to vacate the
13 excess right-of-way within Petaluma Auto Center off
14 Industrial Ave., pursuant to the procedures required under
15 Chapter 3, Part 3, of the Streets and Highways Code,
16 commencing with Section 8320 thereof.. The street right-of-
17 way to be vacated is described on a map, which shows the
18 portion or area to vacated, on file in the office of the
19 City Engineer, City Hall, Petaluma, California, and
20 incorporated herein by reference.

22 BE IT FURTHER RESOLVED that the City Council does hereby fix
23 Monday July 2, 1990, at the hour of seven o'clock p.m., or
24 as soon thereafter as can be heard, in the Council Chambers,
25 City Hall, Petaluma, California, as the time and place for
26 hearing of all persons interested in or objecting to the
27 proposed vacation of said street right-of-way as described
28 herein.

Being a portion of the `l ands of'Arroyo~Partners as said
lands are described by Deed recorded un-der Doc. No. 85-
0026'74 and 85-032119, of Official Records, Sonoma County
Records (SCR); more particularly described as follows:
Commencing at the .common Northeasterly corner of Parcels 1
and 2 as shown upon Petaluma Parcel Map recorded in Book 366
of Maps, at page 2'4, of Official Records., Sonoma County
Records (SCR), said corner being marked by a 1/2" iron pipe
tagged RCE 26.312;. thence along the Northeasterly boundary of
_- said Parcel 2, North 55`° 07' 00" West, 341.7,6 feet to the
true point of beginning of the parcel her-ein described;
thence .Leaving acid boundary, South 34° 53' 00" West, 181.11
feet,• thence on a curve~to the left with radial bearings of.
South 55° 07' 00" East and South~45° 40' 14`" West having a
radius of 30.00 feet, a central angle of 79° 12' 46" for a
length of 41.48 feet to-a point on the Norhteasterly right-
of-way of Industrial Ave.; thence.Northwesterly along said
right-of-way on'.a.curve to the left with radial bearings of
South 45° 40' 14" West 'and North 35'° 55' 24"-East having a
radius of 680.00 feet,. a central angle of 9° 44! 50" for a
length of 11.5..68 feet; thence leaving said right-of-way, on
a curve to the left with radial bearings of North. 35° 55'
24" East and South 55° 07' 00" East having a radius of 30.00
feet a central angle of 91° 02'.24" for a length to 47.67
feet; thence North 34° 53' 00" East, 168.68 feet to a point
on the Northeaster y line of said Parcel 2; thence along
said Northeasterly line of Parcel 2, South 55° ,07' 00" East,.
60.00 feet to the point of beginning.
"Reserving however to Pacific Gas and Electric Company the
right-from time to time to install, maintain, repair,

operate, replace, remove and renew lines of pipes, wires,
poles and other structures, equipment and fixtures both
above and under ground for the operation of said facilities
in a 10' area adjacent to Industrial Ave on said street to
be abandoned. No buildings or other structures are to be
erected in said street."; and,
"EXCEPTING AND RESERVING THEREFROM PURSUANT TO THE
PROVISIONS OF Section 8340 of the Street and Highways Code
and for -the benefit of Pacific Bell and Viacom Cablevision,
the permanent easement and the right at any time or from
time to time to construct, maintain, operate, replace,
remove., renew and enlarge lines of pipe, conduits, cable,
wires,. poxes and other convenient structures, equipment and
fixtures for the operation of telegraphic arid, telephone
lines and other communication facilities, including access
and the right to keep the property free from inflammable
materials and wood growth, and otherwise pr-otect the same
from all hazards, in, upon, over and across a 10' portion
adjacent to Industrial Ave. in said street to be abandoned;"
and,
Excepting and reserving to the City of Petaluma those
easements and right. to maintain., repair., construct or
reconstruct sanitary'sewer and other public utility
facilities (.Deed #1.982 O.R. 894) in said street and the
right of ,all necess'ar-y entry therefore.
