UNDERGROUND 7 UTILITY DISTRICT BOUNDARIES 8 AS MORE PARTICULARLY DESCRIBED IN THE BODY g OF THIS RESOLUTION 10 11 12 WHEREAS, Ordfinance No. 893 N.C.S., Chapter 14.36 of the 13 Petaluma Municipal Code establishes a procedure for the 14 creation of an underground utility district and requires as 15 the initial step in such procedure the holding of a public 16 hearing to ascertain whether public necessity, health, 17 safety, or welfare require the removal of poles, overhead 18 wires and associated overhead structures and the underground 19 installation of wires and facilities for supplying electric, 20 communication or similar or associated service in any such 21 district; and, 22 23 WHEREAS, a public hearing was duly noticed 1/21/86 in the 24 Council Chambers in the City Hall, Petaluma, California, to 25 ascertain whether the public necessity, health, safety or 26 welfare require the removal of poles, overhead wires and 27 associated overhead structures and the underground 28 installation of wires and facilities for supplying electric, 29 communication or similar or associated service in the 30 district described below; and, 31 32 WHEREAS, such hearing has been duly and regularly held, and 33 all persons interested have been given an opportunity to be 34 heard; and, 35 36 WHEREAS, Resolution #86-207 N.C.S. was adopted on July 21, 37 1986 establishing South McDowell Blvd. Underground District; 38 and, 39 90-176 Rcs. N.C:S. 1 WHEREAS, it .has .been. recommended that the boundaries of the 2 South McDowell Blvd. Underground District be modified to 3 include six (6) more parcels. 4 5 NOW, THEREFORE, BE IT RESOLVED as follows:. 6 7 1. NOTICE IS HEREBY GIVEN that a public hearing will be 8 held by the Council of the_C-ty of Petaluma on June 18, 9 1990, at the hour of 7:00 p.m., or as soon thereafter 10 as the matter can be heard, in the Council Chambers of 11 the City Hall, 'Petaluma, California, to ascertain 12 whether the public necessity, health, safety or welfare 13 require the removal of poles, overhead wires and 14 associated overhead structures and the underground 15 installation of wires and facilities for supplying 16 electric, communication or similar associated service 17 in the District herein described. 18 19 2.' At such hearing all persons interested shall be given 20 an opportunity to be heard.. Said hearing may be 21 continued from time to time as may be determined by the 22 City Council. 23 24 3. The City Clerk shall notify all affected .property 25 owners as shown on the last equalized assessment roll 26 and utilities concerned of the time and place of such 27 hearing by mailing a copy of this resolution to such 28 property owners and utilities concerned at least ten 29 (10) days prior to the date hereof.
