9 6dHBRBAS, Hubert Smith, on behalf of the proposed Hoot's
10 Auto and Diesel Electric at 501 Lakeville Hwy, has requested
it a storm drain reimbursement agreement for the construction
12 of the second phase of the Sonoma County Water Agency -
13 Wilson/Lakeville St. project; and,

16 L~IHBRBAS, the Sonoma County Water Agency Zone 2A Committee
17 has recommended funding in the 1990-91 Sonoma County Budget
18 for said project; and,

21 b~HBRBAS, construction by Hoots Auto and Diesel Electric
22 would avoid future of business disruption if the project.
23 were constructed by the Sonoma County Water Agency; and,

26 idHBRBAS, a savings of public funds would result by Hoot's
27 Auto and Diesel Electric installation of the Wilson St/
28 Lakeville Storm Drain Project since construction would occur
29 in undeveloped property; and,

2 WHEREAS, the Sonoma County Water Agency is willing to
3 reimburse the City of Petaluma for the second phase
4 Wilson/Lakeville St Project from proposed 1990-91 budget
5 funds.

8 NOW, THBR$FORB, BE IT RESOLVED that the City of Petaluma
9 agrees to a storm drain reimbursement agreement with Hubert
10 Smith, representing Hoot's Auto and Diesel Elec tric for the
11 construction of the second phase of the Sonoma County Water
12 Agency Wilson/Lakeville St. Storm Drain Project through Mr.
13 Smith's property and authorize the City Manager to sign said
14 agreement.
