HomeMy WebLinkAboutResolution 90-197 06/18/1990Resolution No. 90-197 N.C.S. of the Cite of Petaluma, California 1 A RESOLUTION DESCRIBING IMPROVEMENTS AND DIRECTING 2 PREPARATION 3 OF ENGINEER'S REPORT FOR FISCAL YEAR 1990-91 4 ANNUAL ASSESSMENT FOR 5 LANDSCAPE ASSESSMENT DISTRICTS 6 7 WHEREAS, pursuant to the provision of the Landscaping and Lighting Act 8 of 1972, Part 2, Division 15 of the Streets and Highways Code of the State of 9 California, the City Council conducted proceedings for the formation of 10 Landscape Assessment Districts and Authorizing Levy and Collection of 11 Assessments Pursuant to Landscaping and Lighting Act of 1972, as listed in 12 Exhibit A attached hereto; 13 14 NOW, THEREFORE, BE IT RESOLVED by the Council of the City of 15 Petaluma, County of Sonoma as follows: 16 17 1. The public interest, convenience and necessity require, and it is the 18 intention of said Council to undertake proceedings for the levy and collection of 19 assessments upon the several parcels of land in said districts, for the construction 20 or installation of improvements, including the maintenance or servicing, or both, 21 thereof for the Fiscal Year 1990-91; 22 23 2. The improvements to be constructed or installed, including the 24 maintenance or servicing, or both, thereof, are more particularly described for 25 each District in Exhibit B attached hereto; 26 27 28 3. The costs and expenses of said improvements, including the maintenance 29 or servicing, or both, thereof, are to be made chargeable upon said districts, the 30 exterior boundaries of each district are the composite and each consolidated area 31 as more particularly shown on a map thereof on file in the office of the City Clerk 32 of the City of Petaluma, to which reference is hereby made for further particulars. 33 Said maps for each District indicates by a boundary line the extent of the territory 34 included in said district and of any zone thereof and shall govern for all details as 35 to the extent of each assessment district; 36 37 4. The City Engineer of Petaluma shall be the Engineer of Work, and is 38 hereby dirdcted to prepare and file with the City Clerk a report on each district 39 specifying the fiscal year to which the report applies, and, with respect to that 40 year, presenting the following: 41 42 a) Plans and specifications of the existing improvements 43 and for proposed new improvements, if any, to be made 44 within the assessment district or within any zone 45 thereof; Res No_......99-...1.9.7.. NCS 1 b) An estimate of the costs of said proposed new 2 improvements, if any, to be made, the costs of 3 maintenance or servicing, or both, thereof, and of 4 any existing improvements, together with the 5 incidental expenses in connection therewith; 6 7 c) A diagram showing the exterior boundaries of the 8 assessment district and the lines and dimensions of 9 each lot or parcel of land within the district as 10 such lot or parcel of land is shown on the County 11 Assessor's map for the fiscal year to which the 12 report applies, each of which lots of parcels of land 13 shall be identified by a distinctive number or letter on 14 said diagram; and 15 16 d) A proposed assessment of the total amount of the 17 estimated costs and expenses of the proposed new 18 improvements, including the maintenance or servicing, 19 or both, thereof, and of any existing improvements upon 20 the several parcels of land in said district in 21 proportion to the estimated benefits to be received 22 by such parcels of land from said improvements, 23 including the maintenance or servicing, or both, 24 thereof, and of the expenses incidental thereto. 25 26 5. The Director of Finance of Petaluma is hereby designated as the person 27 to answer inquiries regarding any protest proceedings to be had herein, and may 28 be contacted during regular office hours at the Petaluma City Hall, P.O. Box 61, 29 11 English Street, Petaluma, CA 94952, or by calling 707-778-4352. Under the power and authority conferred upon this Council by the Charter of said City.
