PRELIMI'NA.RY APPROVAL OF 2 ENGINEER'S -'REPORT FOR 3 LANDSCAPE ASSESSMENT DISTRICTS 4 { 5 FISCAL YEAR 1990-91 6 7 WHEREAS, the City Council of Petaluma did adopt that certain 8 Resolution , Describing Improvements and Directing Preparation of Engineer's 9 Report for Fiscal Year 1990-91 and pursuant to the Landscaping and Lighting Act 10 of 1972, for the Landscape Assessment Districts, in said City,listed in Exhibit A 11 attached hereto, and did refer the proposed improvements to the Engineer of 12 Work, and did therein direct said Engineer of Work prepare and file with City 13 Clerk of said City a report on each district, in writing, all as therein more 14 particularly described, under and pursuant to the Landscaping and Lighting Act of 15 1972. 16 17 WHEREAS, said Engineer of Work prepared and filed with the City Clerk 18 of said City reports on each district, in writing as called for in said Resolution and 19 under a pursuant to said Act, which reports have been presented to this Council 20 for consideration; and 21 22 WHEREAS, said Council has duly considered each report and each and 23 every part thereof, and finds that each and every part of said reports is sufficient, 24 and that neither said reports, nor any part thereof should be modified in any 25 respect; _ 26 27 BE IT RESOLVED by the City Council of the City of Petaluma, County of 28 Sonoma as follows: 29 30 1. That the plans and specifications for the existing improvements within 31 the assessment districts listed in Exhibit A or within any zone thereof, contained 32 in said report for each district, be, and they are hereby, preliminarily approved. 33 34 2. That the Engineer's estimate of the itemized and total costs and 35 expenses of said improvements, maintenance and servicing thereof, and of the 36 incidental expenses in connection therewith, contained in said reports, be, and 37 each.of them are hereby, preliminarily approved. 38 39 3. That the diagram showing the exterior boundaries of the assessment 40 districts referred to and described in said Resolution and also the boundaries of 41 any zones therein and the lines and dimensions of each lot or parcel of land within 42 said districts as such lot or parcel of land is shown on the County Assessor's maps 43 for the fiscal year to which the report for each district applies, each of which lot or 44 parcel of land has been given a separate number upon said diagram, as contained 45 in said reports, be, and it is hereby preliminarily approved. That the proposed assessment of the total amount of the estimated costs 3 and expenses of the proposed improvements upon the several parcels of land in 4 each district in proportion to the estimated benefits to be received by such 5 parcels, respectively, from said improvements including the maintenance or 6 servicing, or both thereof, and of the expenses incidental thereto, as contained in 7 said reports, be, and they are hereby, preliminarily approved. 8 9 5. That said reports shall stand as the Engineer's Report for each to individual District as listed in exhibit A for the purpose of all subsequent 11 proceedings to be had pursuant to said Resolution . Notice is hereby given that Monday, July 16, 1990 at the hour of 7:00 PM, 2 in the regular meeting place of said Council, Council Chambers, City Hall, 11 3 English Street, Petaluma; California, be and the same are hereby appointed and 4 fixed as the -time and place for a hearing by this Council on the question of the levy 5 and collection of the proposed assessments for each District for the construction 6 or installation of said improvements, includin&-the maintenance and servicing, or 7 both, thereof, and when and where it will consider all ,statements and all written s protests made or filed by any interested person at or before the conclusion of said- 9 hearing, against s.ai,d improvements, the boundaries of each assessment district 10 and any zone therein, the proposed diagram or the proposed assessments, to the 11 Engineer's estimate of the cost thereof, and when and where it will consider and 12 finally act upon the Engineer's Report for each District. 13 14 5. The City Clerk of said City, is hereby directed to give notice of said 15 hearing by causing a copy of this resolution to be published once in a newspaper of 16 general circulation circulated in said City, and by conspicuously posting a copy 17 thereof upon the official bulletin board customarily used•by the Council for the 18 posting of notices, said posting and publication to be had and completed at least .19 ten (1.0) days prior to the date of hearing specified herein. 20 21 6. The Director of Finance said City is hereby designated as the person to 22 answer inquiries regarding any. protest proceedings. to be had herein, and may be 23 contacted during reggular office hours at the Petaluma City Hall, 1.1 English Street, 24 Petaluma, CA 94952, or by cafling 707-778-4352.
