HomeMy WebLinkAboutResolution 90-199 06/18/199011 Resolution No. 90-199 N.C.S. of the City of Petaluma, California 1 A RESOLUTION OF INTENTION TO ORDER THE LEVY AND 2 COLLECTION OF ASSESSMENTS PURSUANT TO THE 3 LANDSCAPING AND LIGHTING ACT OF 1972 FOR 4 LANDSCAPE ASSESSMENT DISTRICTS 5 6 FISCAL YEAR 1990-91 7 8 9 WHEREAS, pursuant to that certain Resolution, Describing 10 Improvements and Directing Preparation of Engineer's Reports for Fiscal Year 11 1990-91. Landscape Assessment Districts , adopted by the City Council of 12 Petaluma, pursuant to the Landscaping and Lighting Act of 1972, the Engineer of 13 Work of said City has prepared and filed with the City Clerk of this City the 14 written reports for each District, listed in Exhibit A attached hereto, called for 15 under said Act and by that certain Resolution , which said reports has been 16 submitted and preliminarily approved by this Council in accordance with said Act: 17 18 NOW, THEREFORE, IT IS HEREBY FOUND, DETERMiINED AND 19 ORDERED, 20 as follows: 21 22 1. In its opinion the public interest and convenience require and it is the 23 intention of this Council to order the levy and collection of assessments for Fiscal 24 Year 1990-91 pursuant to the provisions of the Landscaping and Lighting Act of 25 1972, Part 2, Division 15 of the Streets and Highways Code of the State of 26 _ California, for the construction -or installation of the improvements, including the 27 maintenance or servicing, or both, thereof, more particularly described for each 28 and every District in Exhibit B attached hereto: 29 30 31 2. The cost and expenses of said improvements for each Assessment 32 District, including the maintenance or servicing, or both, thereof, are to be made 33 chargeable upon the said assessment district the exterior boundaries of which 34 district are the composite and consolidated area as more particularly described on 35 a map thereof on file in the office of the City Clerk of said City, to which reference 36 is hereby made for further particulars. Said map indicates by a boundary line the 37 extent of the territory include in each of the districts and of any zone thereof and 38 the general location of said districts. 39 40 3. Said Engineer's Report for each District prepared by the Engineer of 41 Work of said City, preliminarily approved by this Council, and on file with the City 42 Clerk of this City is hereby referred to for a full and detailed description of the 43 improvements, the boundaries of the assessment district and any zones therein, 44 and the proposed assessments upon assessable lots and parcels of land within the 45 districts. Notice is hereby given that Monday, July 16, 1990 at the hour of 7:00 PM, 2 in the regular meeting place of said Council, Council Chambers, City Hall, 11 3 English Street, Petaluma, California, be and the same are hereby appointed and 4 fixed as the time and place for a hearing by this Council on the question of the levy 5 and collection of the proposed assessments for each District for the construction 6 or installation of said improvements, including the maintenance and servicing, or 7 both, thereof, and when and where it will consider all statements and all written 8 protests made or filed by any interested person at or before the conclusion of said 9 hearing, against said improvements, the boundaries of each assessment district 10 and any zone therein, the proposed diagram or the proposed assessments, to the it Engineer's estimate of the cost thereof, and when and where it will consider and 12 finally act upon the Engineer's Report for each District. 13 14 5. The City Clerk of said City, is hereby directed to give notice of said 15 hearing by causing a copy of this resolution to be published once in a newspaper of 16 general circulation circulated in said City, and by conspicuously posting a copy 17 thereof upon the official bulletin board customarily used by the Council for the 18 posting of notices, said posting and publication to be had and completed at least 19 ten (10) days prior to the date of hearing specified herein. 20 21 6. The Director of Finance said City is hereby designated as the person to 22 answer inquiries regarding any protest proceedings to be had herein, and.may be 23 contacted during regular office hours at the Petaluma City Hall, 11 English Street, 24 Petaluma, CA 94952, or by calling 707-778-4352.
