UNDERGROUND DISTRICT 6 7 8 WHEREAS, a public hearing was duly noticed 6/18/90 in the 9 Council Chambers in the City Hall, Petaluma, California, to 10 ascertain whether the public necessity, health, safety or 11 welfare require the removal of poles, overhead wires and 12 associated overhead structures and the underground 13 installation of wires and facilities for supplying electric, 14 communication or similar or associated service in the 15 district described below; and, 16 17 WHEREAS, such hearing has been duly and regularly held, and 18 all persons interested have been given an opportunity to be 19 heard. 20 21 NOW, THEREFORE, BE IT RESOLVED that the council of the City 22 of Petaluma hereby finds and determines that the public 23 necessity, health, safety and welfare require the removal of 24 poles, overhead wires and associated structures, and the 25 underground installation of wires and facilities for 26 supplying electric, communication or similar or associated 27 service in the district more particularly described in the 28 attached Exhibit B and such described area is hereby 29 established as Amended South McDowell Boulevard Underground 30 District. 31 32 BE IT FURTHER RESOLVED that the following exceptions in said 33 Underground Utility District be, and they are hereby 34 authorized: 35 36 A. Any municipal facilities or equipment installed under 3'7 the supervision and to the satisfaction of the City 3g Engineer; kes. v~.....90.-_2,04....... n~.cs. ;+ 1 B. Poles or electroliers used exclusively for street 2 lighting; 3 4 C. Overhead wires (exclusive or supporting structures) 5 crossing any portion of a District within which 6 overhead wires have been prohibited, or connecting to 7 buildings on the perimeter of a District, when such 8 wires originate in an area from which poles, overhead 9 wires and associated overhead structures are not 10 prohibited. 11 12 D. Poles, overhead wires and associated overhead 13 structures used for the transmission of electric energy 14 at nominal voltage in excess of 34,500 volts; 15 16 E. Overhead wires attached to the exterior surface of a 17 building by means of a bracket or other fixture and 18 extending from one location on the building to another 19 location on the same building or to an adjacent 20 building without crossing any public street; 21 22 F. Antennae, associated equipment and supporting 23 structures, used by a utility for furnishing 24 communication services; 25 26 G. Equipment appurtenant to underground facilities, such 27 as surface mounted transformers, pedestal mounted 28 terminal boxes and meter cabinets, and concealed ducts; 29 and, 30 31 H. Temporary poles, overhead wires and associated overhead 32 structures used or to be used in conjunction with 33 construction projects. 34 35 BE IT FURTHER RESOLVED that all poles, overhead wires and 36 associated overhead structures shall be removed and Re,so. 90-204 N.C.S. '~ 1 underground installations made in said underground utility 2 district within the .following times: 3 4 A. Underground installation by utility companies and 5 property owners and reconnections not later than 6 August 15, 1990. 7 8 B. Removal of poles, overhead wires and other associated 9 overhead structures not later than September 15,.1990. 10 11 BE IT FURTHER RESOLVED that the City Clerk, within ten (10) 12 days after the adoption of this resolution shall mail a copy 13 thereof and a copy of Ordinance No. 893 N.C.S. to affected 14 property owners as such are shown on the last equalized roll 15 and to the affected utilities. 16 17 18 19 addhomes Under the power and authority conferred upon this Council by the Charter of said City.
