HomeMy WebLinkAboutResolution 90-220 07/02/1990t ReSOIL,ItI®Cl N®. gn-~~~ NC.S. of the City of Petaluma, California RESOLUTION UPHOLDING THE APPEAL OF THE PLANNING COMMISSION'S DENIAL OF THE PUD UNIT DEVELOPMENT PLAN FOR THE RANCHO UNDO ESTATE'S SUBDIVISION AP NOS. 19-232-11 and 18. WHEREAS, on April 10, 1990 the Planning Commission voted to deny the PUD Unit Development Plan to allow a 10 lot subdivision on Mountain View Avenue off Rancho Lindo Drive; and WHEREAS, an appeal of the Planning Commission's determination was appropriately filed on April 18, 1990 by Raymond. Nizibian stating objection to the denial of the PUD Unit Development Plan; and WHEREAS, the City Council held a public hearing on May 21, 1990 to consider this appeal and consider all reports, agency comments and testimony presented at this meeting; NOW, THEREFORE BE IT RESOLVED that the City Council hereby approves the PUD Unit Development Plan for Rancho Lindo Estates with the findings and conditions as follows: Findin s: 1. This project, as conditioned, is consistent with the City of Petaluma Zoning Ordinance and the requirements of the Planned Unit Development Zoning District. 2. This project, as conditioned; is consistent with the City of Petaluma General Plan. 3. This project will not result in significant land use or environmental impacts. A negative declaration has been recommended. Conditions: 1. Drainage and grading design shall in conformance with the Sonoma County Water Agency Flood Control Design Criteria, subject to the approval of the City Engineer. 2. The following requirements of the Chief Building Inspector shall be complied with, subject to his review and approval: k~~5. v~_.....90,-.2.20.... v.cs. 1 a. Grading must be certified when completed to indicate compliance with approved plans and will be required for occupancy. b. Any holding tank required for elevations above 160 feet must meet Engineering Department design requirements. c. Where ground slopes greater than 1 on 10, foundation shall be stepped per Uniform Building Code 2907(c). d. Soils with expansion index greater than 20 require special design foundation per Uniform Building Code 2904(b). e. Indicate all utilities on site plan. f. Verify utilities are adequate for building (i.e., size of water, electrical and gas service and size of sewer). g. Driveway gradient shall comply with Ordinance No. 1533/1982. h. Responsible party to sign plans. i. Submit soils report to verify foundation design. j. Demolition permit needed to remove any structure. k. Any abandoned wells must be capped as required by Sonoma County Health Department 1. Any abandoned septic tank must meet Building Code requirements. 3. The following requirements of the Fire Marshal shall be complied with, subject to his review and approval: a. Project will require the installation of automatic fire sprinklers in all structures. Fire sprinkler system shall be designed and installed in accordance to N.F.P.A. 13-D including the attic space and garage protected. Reso. 90-220 N.C.S. 2 b. All roof covering material shall have class "B" rating or better, treated in accordance with the Uniform Fire Code Standard 32.7. c. Provide access, minimum twenty feet (20) unobstructed all weather hard surface thirteen feet six inches (13' 6") vertical height clearance to lots 3, 4, 7, 8 and 9. d. Post "No Parking, Fire Lane" signs on private driveways. e. All hazardous materials (as recognized by the City Fire Marshal) utilized on the construction site shall be kept within a locked, fenced enclosure, subject to review and approval by City staff. 4. The following operating practices shall be complied with during construction activity on the project: a. Hours of construction activity shall be limited to the hours of 7 AM to 6 PM, Monday through Friday (non-holidays) except for quiet, interior work which will not produce exterior noise. The developer's telephone number shall be available for noise complaints.) b. All construction equipment powered by internal combustion engines shall be properly muffled and maintained to minimize noise. Unused equipment shall be turned off when not in use. c. All exposed portions of the site shall be completely sprinkled with water as needed to provide adequate dust control as determined by City staff. Major dust-generating activities shall be scheduled for the early morning hours when wind velocities are low. All storage piles shall be covered, including, but not limited to fill., refuse, etc. d. All construction related traffic shall access the site by using the existing 50' roadway and public utility easement across A. P. No. 19-232-17. A temporary roadway to accommodate construction traffic shall be provided across this parcel and the project site from Mountain View Avenue, subject to City 3 Reso. 90-220 N.C.S. 1 approval. All construction traffic shall use this access road, moisture content 2 of soil permitting. Road usage during wet weather shall be subject to staff 3 determination. 4 5 5. The Unit Development Plan, Landscape Plan and tentative map for this proposed 6 development are subject to review and approval of the Site Plan and Architectural 7 Review Committee prior to approval of the Final Map. 8 9 6. Prior to approval of the final map, the existing Eucalyptus trees shall be pruned by a 10 certified arborist/horticulturalist. The arborist/horticulturalist and method of 11 pruning shall be subject to staff review and approval. 12 13 7. An expanded soils report shall be submitted for City staff review and approval in 14 conjunction with SPARC review of this project. The expanded report shall consider 15 impacts related to flooding/sliding. The impact of the proposed development, 16 including proposed drainage improvements, on surrounding sites shall be considered 17 as well as the potential for off-site sliding from uphill sites. 18 19 8. Final location of the trenched interceptor subdrains and detailed grading plans for 20 the subdrains shall be subject to staff review. If determined necessary by the 21 Community Development Department, a certified arborist/horticulturalist shall be 22 retained by staff at the applicant's expense to review the impact of the subdrains on 23 the Eucalyptus trees to the east. 24 25 9. A detailed grading plan shall be submitted for SPARC review and approval. The 26 plan shall include the location, length, height and construction materials for all 27 retaining walls. The plan shall show the location and extent of grading, filling or 28 cutting necessary for construction of the cul-de-sac and accessways to lots 3 and. 4, 7 29 and 8, and 9. 30 31 10. All spoils associated with this development shall be removed to a disposal site 32 approved by City staff. 33 34 11. Hand trenching only for utility construction shall be required within one and one 35 half times the drip line of the 12" diameter oak on the parcel west of lot 7. Hand 36 trenching only for utility construction shall be required within 25 feet of the trunk of Reso. 90-220 N.C.S. 4 1 the Eucalyptus tree on lot 7. Plans showing the extent of mechanical and hand 2 trenching shall be submitted for staff review and approval prior to final map 3 approval. 4 5 12. The existing drainage course running through the southwest corner of lot seven and 6 across the parcel to the west of lot 7 shall retained in its present location and state. 7 8 13. Sidewalks shall be provided along the extension of Rancho Lindo Drive, including 9 the bulb of the cul-de-sac, subject to the approval of the City Engineer. Sidewalks 10 material shall match the material of the adjacent. existing Rancho Lindo Drive 11 sidewalks. A single material shall be used. for the new sidewalk in the cul-de-sac. 12 13 14. A minimum of five on-site parking spaces (two covered, three uncovered) shall be 14 provided per lot. 15 16 15. This project shall be regulated by the requirements of the R1 20,000 zoning district 17 and the City of Petaluma Zoning Ordinance except where superseded by unit 18 development and pre-tentative map conditions of approval. 19 20 resonz/gary2/council-3 Under the power and authority conferred upon this Council by the Charter of said City.
