F~eSOlUt101'1 NO. 9o-ZZ5 N.C.S. of the City of Petaluma, California 1 RESOLUTION ORDBRING THS VACATION OF EBCESS RIGHT-OF-WAY 2 OFF INDUSTRIAL AVENUE WITHIN THE PROPOSBD 3 AUTO CENTER IN THE CITY OF PETALUMA, CALIFORNIA 4 AMORE PARTICULARLY DESCRIBED IN-THE 5 BODY OF THIS RESOLUTION 6 7 8 WHEREAS, the Council of the City of Petaluma did on the 4th 9 day of June, 1990 adopt its Resolution No. 90-174 N.C.S. 10 declaring its intention to vacate excess right-of-way off 11 Industrial Avenue within the proposed Auto Center 12 hereinafter described, which Resolution was duly and legally 13 posted in the time, form and manner as required by law as 14 shown by the affidavit of posting on file in the Office of 15 the City Clerk of said City; and 16 17 WHEREAS, after the adoption thereof, notices of the passage 18 of said Resolution headed "Notice of Vacation, of excess 19 right-of-way off Industrial Avenue within the proposed Auto 20 Center" were duly and legally posted in the time, form and 21 manner as required by law as shown by the affidavit of 22 posting on file in the Office of the City Clerk; and 23 24 WHEREAS, said Council has, on the 2nd day of July, 1990 held 25 a public hearing for the purpose of hearing the evidence of 26 any person interested in or objecting to said proposed 27 abandonment and vacation; and, 28 29 WHEREAS, said Council, having duly received and considered 30 evidence concerning the jurisdictional facts in this 31 proceeding and finds from all the evidence submitted that 32 the easement for street purposes hereinafter described is 33 unnecessary for present or prospective public street 34 purposes, and the said Council of the City of Petaluma 35 having now acquired jurisdiction to order the proposed 36 abandonment and vacation; Res. N.C.S. 1 ATOW, THEREFORE, BB IT RBSOI,VED by the Council of the City of 2 Petaluma, pursuant to and in accordance with the authority 3 contained in the Street Vacation Act of 1941, that the 4 following real property for street purposes in said City be, 5 and the same is hereby ordered vacated, abandoned and 6 forever closed to public use: 7 8 See Exhibit."A" 9 10 BB IT FURTHER RESOLVED that the City Cleric is directed to 11 cause a certified copy of this Resolution, attested by said 12 Clerk under the seal of said City, to be recorded in the 13 Office of the Recorder of Sonoma County, California. 14 15 BE IT FURTHER RESOLVED the City Manager is authorized to 16 negotiate the disposition of the underlining real property. 17 18 19 20 21 22 23 24 25 26 27 9th 28 Under the power and authority conferred upon this Council by the Charter of said City.
