1 REQUESTING THE BOARD OF SUPERVISORS TO CREATE
2 THE SONOMA COUNTY TRANSPORTATION AUTHORITY
3 APPROVING THE MEMBERSHIP OF THE GOVERNING BODY OF THE
4 AUTHORITY
5 APPOINTING A REPRESENTATIVE TO THE AUTHORITY
~ APPROVING THE SONOMA COUNTY TRANSPORTATION AUTHORITY
7 EXPENDITURE PLAN
s DESIGNATING THE SONOMA COUNTY TRANSPORTATION AUTHORITY AS
9 THE RESPONSIBLE AGENCY FOR THE PREPARATION AND ADOPTION OF A
Zo CONGESTION MANAGEMENT PLAN; AND
u APPROVING AN ANNUAL APPROPRIATIONS LIMIT
12 WHEREAS, the Sonoma County Transportation Committee consisting of representatives
13 of the cities, the Board of Supervisors and private industry has recommended
14 the creation of a County Transportation Authority to finance certain street,
15 highway and public transit improvements; and,
16 WHEREAS, the Board of Directors of the proposed Authority (sitting as a committee
17 pending the creation of the Authority) has adopted a proposed Expenditure
18 Plan; and,
i~ WHEREAS, the Local 'Transportation Authority and Improvement Act and Government
20 Code Section 65089 require the concurrence of a majority of the cities having
21 a majority of the incorporated population within the County for the creation
22 of an authority and an entity to prepare and adopt a Congestion
23 Management Plan:
24 NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma
25 finds, determines, declares and orders as follows:
26 1. That it is in the best interest of the City of Petaluma and it is hereby
27 requested that the Sonoma County Board of Supervisors create the Sonoma
28 County Transportation Authority pursuant to the Local Transportation
29 Authority and Improvements Act (Public Utilities Code Section 180000 et
30 seq).
31 2. That this City Council concurs in the recommendation of the Sonoma County
32 Transportation Committee that the governing body of the Sonoma County
33 Transportation Authority shall consist of 11 members composed as follows:
34 One Ciry Gouncilmember from each incorporated
35 City and three members of the Sonoma County

1 3. That Councilmember Brian Sobel is hereby appointed to serve, at the will and
2 pleasure of this Council, as the City's representative on the Board of
3 Directors of the Sonoma County Transportation Authority and that
4 Councilmember Larry Tencer shall serve as an alternate.
5 4. That the Sonoma County Transportation Expenditure Plan, as approved by
6 the Sonoma County Transportation Authority (sitting as a committee) at its
~ meeting of July 23, 1990, is approved and recommended to the Authority for
8 adoption.
9 5. That the Sonoma County Board of Supervisors is requested to call a Special
1o Election for November 6, 1990, for voter approval of:
11 a. A countywide Retail Transaction and Use Tax to
12 be levied at a maximum rate of 0.75 percent;
13 b. A maximum bonding authorization of $200
14 million, and
15 c. An annual appropriations limit for the Authority
16 sufficient to accommodate projected revenue from
17 the proposed countywide Retail Transactions and
is Use Tax.
19 6. That the actions authorized by this resolution are exempt from the
20 requirements of the California Environmental Quality Act by virtue of
21 exemptions for transportation improvement programs and projects that are
22 subrrutted to a vote of the electorate (Public Resources Code Section
23 21080(b)(14), California Administrative Code Sections 15276 and 15378).
24 7. That pursuant to the requirement of Government Code Section 65089, the
25 Sonoma County Transportation Authority shall prepare, adopt and
26 administer a Congestion Management Program for Sonoma County that
27 meets the requirements of law.
2s 8. The City Clerk shall forthwith deliver a certified copy of this resolution to the
29 Clerk of the Sonoma County Board of Supervisors.
