RESOLUTION I~IODIFYING
SPARC CONDITIONS OF THE LEN NIBBI
OFFICE BUILDING LOCATED AT
300 LAKEVILLE ST. AT EAST D ST.
WHEREAS, the City Council has considered the SPARC referral
of Condition Nos. 5 and 12.
NO6d, THEREFORE, BE IT RESOLVED that SPARC Conditions No. 5
and 12 are revised as follows:
"SPARC Condition No. 5 shall be deleted.
SPARC Condition No. 12 shall be revised as follows:
All requirements of the Engineering Department shall be
complied with, including:
a. Applicant shall contribute $20,590 to the future
widening of "D" Street.
b. Applicant shall cause plans to be prepared by a
registered civil engineer for the widening of "D"
Street across the property frontage including
appropriate conforms. The design will consider
possible closure of Hopper Street to Southbound
Lakeville Street access.

c. Right-of-way dedication off the "D" Street frontage and
Hopper Street if appropriate will be required as a
condition of the development.
d. The developer shall contribute $.2,650 to the
anticipated railroad drop gate relocation. If the City
successfully receives a 90% Federal 10% local share of
the relocation project, the developer's contribution
shall be reduced to $265.
e. Until the City widens the °tD" Street frontage including
modification of the railroad drop gates and traffic
signals, the "D" Street entrance shall be restricted to
access only and all egress from the property shall be
to Hopper Street.
f. The project shall be designed so that the entrance and
exit driveways are angled toward the access street to
discourage wrong way access movement to the project
site.
g. As part of the project construction, the applicant will
relocate water and ewer services, install new sidewalk
along the "D" Street frontage, and develop an access
driveway from the site to the existing curb line. The
City will also grant an encroachment permit for

landscaping of the area between the .new sidewalk and
existing curb, until such time as the City constructs
the "D" Street widening project.
h. The developer would pay the appropriate traffic
mitigation fees."
Under the power and authority conferred upon this Council by the Charter of said City.
