HomeMy WebLinkAboutResolution 2009-070 N.C.S. 05/18/2009Resolution No. 2009-070 N.C.S. of the City of Petaluma, California AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH S & S TRUCKING FOR THE HAULING AND BENEFICIAL REUSE OR DISPOSAL OF CITY BIOSOLIDS WHEREAS, the problem of human waste disposal began when communities first formed; and, WHEREAS, the large-scale cropland application of municipal wastewater was first practiced about 150 years ago after flush toilets and sewer systems were introduced into cities in Western Europe and North America; and, WHEREAS, in the United States, federal legislation aimed at controlling water pollution first appeared in 1899 and was strengthened during each decade since the 1950s. Thousands of wastewater treatment plants were built, although ocean disposal of residual solids was still permitted; and, WHEREAS, the United States Environmental Protection Agency (EPA) indicated that biosolids that meet treatment and pollutant criteria can be safely recycled and applied as fertilizer to sustainably improve and maintain productive soils and stimulate plant growth; and, WHEREAS, after the 1991 Congressional ban on ocean dumping, the US EPA promulgated regulations - 40 CFR Part 503 -that continued to allow-the use of biosolids on land as fertilizers and soil amendments which had been previously allowed under Part 257; and, WHEREAS, the Part 503 regulations became effective in 1993; and, WHEREAS, biosolids treatment is inherent in the process of wastewater treatment; and, WHEREAS, the City of Petaluma ("City") disposed of biosolids generated by the former Hopper Street treatment plant by hauling and disposal, through .its contract with Camp, Dresser & McKee, the Hopper Street plant contract operator; and, WHEREAS, the City has incorporated technology and systems for appropriate management of biosolids into the design and operation of the Ellis Creek Water Recycling Facility (ECWRF); and, WHEREAS, as part of the implementation of a sound management plan for biosolids produced at the ECWRF, the City intends to continue its existing practice of contracting for hauling and offsite disposal of biosolids; and, WHEREAS, the City issued a Request for Proposals for the Hauling and Beneficial Reuse or Disposal of City Biosolids ("RFP") on March 16, 2009, which was circulated to professionally qualified firms for responses; and, Resolution No. 2009-070 N.C.S. Page 1 WHEREAS, the City received six responses to RFP; and, WHEREAS, the proposals were reviewed based on criteria listed in the RFP, Section 4.4 Proposal Evaluation Process; and, WHEREAS, S&S Trucking received the overall highest ranking based on the City's review of four categories of evaluation factors set forth in the Proposal Evaluation Matrix, which is incorporated herein by reference; and, WHEREAS, factors resulting in S&S Trucking's ranking include, but are not limited to S&S Trucking's combination of biosolids reuse methods resulting in a 100% reuse combination; and, WHEREAS, in the dry season, S&S proposes to haul the biosolids about 10 miles for reuse at a Lakeville Ranch site in Sonoma County currently permitted and used for the application of biosolids as a land .applied dry soil amendment; and, WHEREAS, in the wet season, S&S proposes to haul the biosolids about 64 miles for reuse as Alternative Daily Cover of refuse at Norcal's Hay Road Landfill, Inc., Vacaville, CA, which is permitted by the California Waste Management Board and has US EPA Facility Registration System ID 110017973415 for biosolids with a cease operation date of 1/1/2077; and, WHEREAS, City staff has confirmed that the disposal and reuse sites proposed by S&S Trucking are existing sites operating with required permits and approvals for the methods and uses proposed; and, WHEREAS, other factors resulting in S&S Trucking's ranking include, but are not limited to S&S Trucking's competitive unit pricing; very good reviews from S&S Trucking's .references.; S&S Trucking's proposal to predominately use its own drivers and equipment, with less likelihood of sub-contracting the hauling, resulting in greater probable continuity and reliability; S&S Trucking's provision of the continuous, seamless plastic trailer liners specified in the RFP; and S&S Trucking's shorter haul distance which furthers the City's greenhouse gas emissions reduction goals; and, WHEREAS, the Project consists of the selection of a contract hauler to continue an existing City activity, and the contractor's proposed disposal and reuse methods employ existing sites which are permitted, approved and in use for the methods proposed, the Project does not constitute a "project" under the California Environmental Quality Act ("CEQA"); see Title 14, Chapter 3, California Code of Regulations ("CEQA Guidelines"), Sections 15060(c)(2) and 15368. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows: The above recitals are true and correct and adopted as findings of the City Council of the City of Petaluma. 2. The City Manager is authorized to execute an agreement with S&S Trucking consistent with Appendix 2 of the Request for Proposals for the Hauling and Beneficial Reuse or Resolution No. 2009-070 N.C.S. Page 2 Disposal of City Biosolids ("RFP"), for a term of three years with two potential one year extensions, in a not to exceed amount of $1,550,640.
