HomeMy WebLinkAboutResolution 90-284 08/09/1990resolution NO. 90-284 N C.S. of the City of Petaluma, California REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF SONOMA TO CONSOLIDATE A SPECIAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 6, 1990, WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON THE DATE PURSUANT TO SECTION 23302 OF THE ELECTIONS CODE WHEREAS, the City Council of the City of Petaluma called a Special Municipal Election to be held on Tuesday, November 6, 1990, for the purpose of submitting to the voters measures relating to the amendment of the City Charter; and WHEREAS, it is desirable that the Special Municipal Election be consolidated with the Statewide General Election to be held on the same date and that within the city the precincts, polling places and election officers of the two elections be the same, and that the county election department of the County of Sonoma canvass the returns of the Special Municipal Election and that the election be held in all respects as if there were only one election; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PETALUMA DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. That pursuant to the requirements of Section 23302 of the Elections Code, the Board of Supervisors of the County of Sonoma is hereby requested to consent and agree to the consolidation of a Special Municipal Election with the Statewide General Election on Tuesday, November 6, 1990, for the purpose of submitting to the voters measures relating to the amendment of the City Charter. SECTION 2 . That a measure is to appear on the ballot as follows VOTER APPROVAL REQUIRED OF ARBITRATOR'S AWARDS. Shall the City Charter be amended to provide that binding arbitration or binding fact-finder awards of wages, benefits 1 RES. v~~........90.-.284..... n.cs. or employee-related expenses not approved by the City Council must be approved by two-thirds of the voters before such awards may be imposed on the City's taxpayers? The measure text is attached as Exhibit (2) . SECTION 3. That the county election department is authorized to canvass the returns of the Special Municipal Election. The election shall be held in all respects as if there were only one election, and only one form of ballot shall be used. SECTION 4. That the Board of Supervisors is requested to issue instructions to the county election department to take any and all steps necessary for the holding of the consolidated election. SECTION 5. That the City of Petaluma recognizes that additional costs will be incurred by the County by reason of this consolidation and agrees to reimburse the County for any costs. SECTION 6. That the City Clerk is hereby directed to file a certified copy of this resolution with the Board of Supervisors and the county election department of the County of Sonoma.. resolution 11 RES02 8/6/90 . No........9.Q.r.,~8~..... N.C.S. The wording of the proposed Charter amendment is as follows: "Section 83. VOTER APPROVAL REQUIRED OF ARBITRATOR'S AWARDS . Wages, benefits or employee-related expenses which have not been approved by resolution of the City Council and which are the result of binding fact-finding or binding arbitration may not be imposed on the taxpayers of Petaluma without approval of the voters as set forth in this section. Notwithstanding any other provision of this Charter, such expenses shall not be paid by the City until additional revenues and appropriations therefor have been approved by vote of the people pursuant to California Constitution Article XIII-A, Section 4 and Article XIII-B, Section 4. The City Council shall not be required to call an election to approve such additional revenues and appropriations more than once a year and may consolidate said elections with elections held for other purposes." ###
