HomeMy WebLinkAboutResolution 90-301 08/20/1990,~ Resolution No. 90-301 N ~.5. of the City of Petaluma, California RESOLUTION APPROVING ISSUANCE OF A MITIGATED NEGATIVE DECLARATION PURSUANT TO CEQA FOR THE CREATION OF THE MAGNOLIA TERRACE SUBDIVISION LOCATED BETWEEN MAGNOLIA AVENUE AND CHERRY' STREET, AP NO'S 006-012-15 AND 20 AND 006-402-08 1 Z 3 4 5 6 7 8 WHEREAS, the Planning Commission has recommended issuance of a Mitigated Negative 9 Declaration pursuant to the California Environmental Quality Act (CEQA) for a proposal 10 to create atwelve-lot residential subdivision between Magnolia Avenue and Cherry Street, 11 west of Keokuk; and, 12 13 WHEREAS, an initial study which noted impacts on traffic, drainage, plant species and 14 scenic qualities has been prepared for the project and has been reviewed by the 15 Community Development Department; and 1.6 17 WHEREAS, the result of this study have indicated that conditional approval of this project 18 will not trigger any significant adverse environmental impacts that cannot be mitigated 19 through conditions of approval; and, 20 21 WHEREAS, staff and the Planning Commission have recommended that a mitigated 22 negative declaration be issued on the above project; 23 24 NOW, THEREFORE, BE IT RESOLVED that the issuance of said Mitigated Negative 25 Declaration pursuant to the California Environmental Quality Act is hereby approved, 26 based upon the following findings: 27 28 1. The project, as conditionally approved, does not have the potential to degrade the 29 quality of the environment, substantially reduce the habitat of a fish or wildlife 30 species, cause a fish or wildlife population to drop below self-sustaining levels, 31 threaten to eliminate a plant or animal community, reduce the number or restrict 32 the range of a rare or endangered plant or animal or eliminate important examples 33 of the major periods of California history or prehistory. 34 35 2. The project, as conditionally approved, does not have impacts which are individually limited, but cumulatively considerable. 4. The project, as conditionally approved, does not have environmental effects which will cause substantial adverse effects on human beings, either directly or indirectly. 5. The traffic impact of this twelve-unit subdivision will be slight, relative to the required improvements and capacity of the existing road network and the impact of the subdivision will be mitigated through conditions of approval. 6. The potential adverse drainage impacts of the project are adequately mitigated through conditions of approval. 7.
