RESOLUTION OF POLICY RESPECTING
RESIDENTIAL CONSTRUCTION AND
POPULATION GROWTH AND REAFFIRMING'
THE CESSATION OF THE ZONING MORATORIUM
WHEREAS, this City Council has found that residential
growth should be restricted in number in order that required
public facilities may more adequately keep pace with citizen
needs and demands ; and
WHEREAS,, this Council has heretofore adopted, by
Resolution 5760 , a development policy to cover a period of five.
years which policy i'ndica'tes , among Other things, that in the
next five years no more than 2500 dwelling units, be constructed
to average out over the period at 500 units per year; and
WHEREAS, by virtue of a moratorium heretofore estab-
lished a number Of building projects have .laih dormant; and
WHEREAS., this Council desires to reaffirm the cessa-
tion of the zoning moratorium and to give guidance to the
Planning Commission as to the methods to be used in carrying
out the five year growth. policy.
NOW, THEREFORE`, BE IT RESOLVED that this Council,
reaffirms that the zoning moratorium heretofore established
has ceased.
BE IT FURTHER RESOLVED that this Council directs
the Planning Commission to process subdivisions , rezonings
and all other matters coming before it that fall within the
scope of this policy and resolution in accordance with the
following guidelines :
1. The Planning Commission shall take appropriate
action to allow the following named applicants to proceed to
develop' "and ,construct in the 1972-73 construction year. The

number of units in parenthesis is the maximum number of dwelling
units each applicant -shall be permitted to' construct. For the
purpose of this Resolution, a construction- year, •.wherever used,
is defined as that twelve month period ,commen'cing May' l of one
year through April 30 of the following year:
a. CAMBRIDGE SQUARE ( 101 units)
SUNCO DEVELOPMENT (/ units for 72-73)
c. CAMILLE ENTERPRISES- (19 units)
d. CONDIOTTI ENTERPRISES (l00 units)
e. FORMAN (36 apt units)

construction year.
The CONDIOTTI ENTERPRISES project is approved by this
Resolution for prezoning ,to a PUD District and' for annexation.
2 . The above-listed applicants' must furnish their
construction schedule on or before May 15., 19.72 .
3 . Henceforth, further developments shall be limited
in number in any construction year to 5'00 dwelling units
(including mobilehomes) , °with the further, limitation that no
more than 250 units be approved on lands easterly of the freeway ,
with the balance to: be allocated to areas located westerly of
the freeway.
4 . The limitations herein imposed shall not apply
to projects not defined, as a subdivision under the provisions
of the Subdivision Map Act (i . e. , four or less lots) nor to
the construction of fourplexes or lesser numbered multiple
dwellings on a single existing lot, nor to Single', family

residential, units pn. a single existing lotj .nor to industrial
br commercial construction.
5'. In October: 1972 , the Planning Commission may
accept applications rfdr: annexation, prezoning, rezoning, for
site review, for preliminary subdivision approval and for
other projects within the meaning] and scope: of this Resolution
which are designed for the residential construction yeas of
1973-74 . The applications listed in pars 1. above . shall. be
given priority for 197.374 , if necessary, but, thereafter,
shall be equal with all other . applicants:.
6 . The ,Planning Commission shall not allocate
more -than 100 units to a single residential . develop'men't to be
constructed in any one construction year:, ,without approval
of the Council. Th-15 Council declares that, upon good
cause shown, and if it is demonstrated that the proposed
project is not economically feasible beeause of the required
off-site or other improvements required and other factors
beyond the developer's control, it -may approve,more than
100 units to a particular ,project..
7. No 'approvals or commitments of :projects shall
be granted for mbi'e 'than five years , particularly in those
instances where the .applicant is proposing 100 units or more
pet year.
8. Transfer, sale, assignment or other disposal
of any applicant's approved project shall be s'ubject to
Council approval.
9 . Any prezoning of territories proposed to be
annexed and to be developed for residential Use Shall not be
zoned unless the land meets all the criteria of '"50b" as
established- by thisrResoluton and Resolution 5760

10. Except. as `to projects herein approved, the
Planning Commission shall not rezone ,or".prezone• any land to
any residential use until the Council shall by resolution
rescind this subsection.. This restriction shall not apply
to single lots 'Or' to divisions of property into four or less
lots.
11. In the event the developments approved in sub-
paragraph 1 above are, not to be fully completed as applied for
and in the construction year i972-7:3 , the Council may, by •
Resolution, authorize the Planning COMMission. to approve other
units as replacements .
BE IT FURTHER RESOLVED that - annually,. commencing
August 1972 , and each and"every August thereafter, this Council
shall 'review the conditions herein established and 'shall , by
Reolution, modify, affirm, revise , . redo 'or take such other
action as it deems proper'.
BE IT FURTHER RESOLVED that except as may be herein
modified, all other provisions of Resolution 5760 shall apply-.

Council of the City of Petaluma on 'the 17th day of
April , 1972 , by' the following Vote :
