HomeMy WebLinkAboutResolution 90-334 10/01/1990Y~ A r ~e5®IUtlOrl N®. 90-334 N~,S, of the City of Petaluma, California RESOLUTION AUTHORIZIPIG DRUG FREE ZONES NEAR SCHOOLS, PARKS AND YOUTH CENTERS WHEREAS,. the sale of drugs to children is particularly deplorable in that it destroys young lives and has disastrous effects on families and communities, as well as the future of the nation; and WHEREAS, the United States Code, Secs 845 and 845(a) of Title 21 provide for enhanced penalties for persons who distribute drugs to individuals under the age of 21 or who distribute drugs within 1,000 feet of schools, swimming pools and other youth centers; and WHEREAS, California Health & Safety Code Sec. 11353.6 provides for enhanced penalties for persons over the age of 18 years who distribute drugs to minors within. 1,000 feet of schools; and WHEREAS, Health & Safety Code Sec. 11353.7 provides for enhanced penalties for persons over the age of 18 years who distribute drugs to minors within public parks; and WHEREAS, the City of Petaluma may request, through the U.S. Attorney General's Office, federal prosecution of violators of Secs. 845 and 845(a) of the United States Code; and WHEREAS, in cases not prosecuted by the U.S. Attorney, the City of Petaluma will request the Sonoma County District Attorney to enhance penalties per the California Health & Safety Code Secs. 11353.6 and 11353.7; His. Na.....9.0.-3.3:4........ ;v.cs. ~.'. 33 NOW, THEREFORE, BE IT RESOLVED that the City Council of the 34 City of Petaluma hereby approves the establishing of "Drug Free 35 Zones" within 1,000 feet of public and private schools, in public 36 parks, and at public swimming pools and youth centers; 37 38 BE IT FURTHER RESOLVED that by copy of this resolution the 39 U.S. Attorney's Office will be advised of the City of Petaluma 40 participation in the war against drugs and encourage federal 41 prosecution to the maximum extent possible for all drug offenders 42 violating the City of Petaluma's "Drug Free Zones". 43 44 BE IT FURTHER RESOLVED that a copy of this resolution be 45 forwarded to the Sonoma County District Attorney's Office; 46 47 BE IT FURTHER RESOLVED that the City Manager is authorized 48 to acquire and post "Drug Free Zone" signs at appropriate places 49 at a cost determined by him to be reasonable. 50 51 Under the power and authority conferred upon this Council by the Charter of said City.
