RESOLUTION ORDERING THE .ABANDONMENT AND CLOSING 049 TO PUBLIC USE TEE SANITARY SEWER EASEMENT ACROSS � ',1p LOTS 17 , 21 , AND 22 OF CHERRY VALLEY SUBDIVISION S; l7q, AND AS .SHOWN ON 'THE NAP -0N FILE IN TEE ,OFFICE OF THE CITY CLER AND MORE PARTICULARLY DESCRIBED IN THE BODY OF THIS PSOLUTON /2 /� ' / /( �"/ L� : At INTRODUCED BY COUNCILMAN ,,,.,� / / 1 4•` ( Regular Meeting of Ricxmciwitia the City Council of the City of Petaluma on the 21st day of August 19 72 YPAEO JzYYP/Y 7 WHEREAS , the Council of the City of Petaluma did, on the 17th day of July, 1972 , adopt its Resolution of Intention No. 6091 N .C .S . , declaring its intention to abandon and close to public use the sanitary sewer .easement hereinafter described, which resolution was duly and legally posted in the time , form and manner as required by law, as shown by the affidavit of post- ing on file in the office of the City Clerk of this City; and WHEREAS, after the adoption thereof., notices of. the passage of said resolution, headed "Notice of Vacation , Abandonment and the Closing to Public Use the Sanitary Sewer Easement Across Lots 17 , 21 and 22 of Cherry Valley Subdivision More Particularly Described Herein" , were duly and regularly posted in the time, form and manner as requited by law as shown by the affi-- davit of posting on file in the office of. the City Clerk; and. WHEREAS, said Council has , on the 21st day of August, 1972 , held a public nearing for the purpose of hearing the evidence of any person inter- ested in or objecting to said proposed abandonment and vacation ; and WHEREAS, said Council having duly received and considered evidence concerning the jurisdictional facts in this proceeding and finds from all the' evidence submitted that the easement or portion' of easement hereinafter de scribed is, unnecessary for present or prospective public use , and the said Council of the City of .Petaluma having now acquired jurisdiction to order the proposed abandonment and vacation; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Petaluma, pursuant to and in accordance with the authority contained in the Public Service Easements Vacation Law (Title V, Division 1 , Part 1 , Chapter 2 , Article 5 of the Government Code of the State of California) , that the follow ing easement for utility purposes in said City be, and the same is , hereby ordered vacated, abandoned and forever closed to public use : "All that certain real property Situate in the City of Petaluma, County of Sonoma., State of California, being that portion of a 10-foot sanitary sewer easement across Lots 17 , 21 , and. 22 of CHERRY VALLEY SUBDIVISION as recorded in Sonoma County Records , Book 162 of Maps , 'Page 28 . Said sewer easement being recorded in Sonoma County Records , Book 1547 , Page 304 . " BE IT FURTHER RESOLVED that the City Clerk is directed to cause a certified copy of this resolution, attested by said Clerk under the seal of this City, to be recorded in the office of the Recorder of Sonoma County, under the power and authority conferred upon this Council by the Charter of said.City. y7%� COUNCILMEN VOTE Seconded by //(,iy..J' '' Ayes, Noes Absent Councilman Robert A.
