2 RESOLUTION APPROVING ISSUANCE OF A MITIGATED NEGATIVE
3 DECLARATION PURSUANT TO CEQA FOR THE CREATION OF THE
4 QUARRY GARDENS SUBDIVISION LOCATED ON McNEAR AVENUE
5 SOUTH OF MISSION DRIVE, AP NO. 008-471-35

7 WHEREAS, the Planning Commission has recommended issuance of a Mitigated Negative
8 Declaration pursuant to the California Environmental Quality Act (CEQA) for a proposal
9 to create afive-lot residential subdivision on McNear Avenue south of Mission Drive; and,
10
11 WHEREAS, an initial study which noted potential impacts on traffic, drainage, and scenic
12 qualities has been prepared for the project and has been reviewed by the Community
13 Development Department; and
14
15 WHEREAS, the result of this study have indicated that conditional approval of this project
16 will not trigger any significant adverse environmental impacts that cannot be mitigated
17 through conditions of approval; and,

19 WHEREAS, staff and the Planning Commission have recommended that a mitigated
20 negative declaration be issued on the above project;

22 NOW, THEREFORE, BE IT RESOLVED that the issuance of said Mitigated Negative
23 Declaration pursuant to the California Environmental Quality Act is hereby approved,
24 based upon the following findings:

26 1. The project, as conditionally approved, does not have the potential to degrade the
27 quality of the environment, substantially reduce the habitat of a fish or wildlife
28 species, cause a fish or wildlife population to drop below self-sustaining levels,
29 threaten to eliminate a plant or animal community, reduce the number or restrict
30 the range of a rare or endangered plant or animal or eliminate important examples
31 of the major periods of California history or prehistory.

33 2. The project, as conditionally approved, does not have the potential to achieve short-
34 term, to the disadvantage of long-term, environmental goals.

36 3. The project, as conditionally approved, does not have impacts which are individually
37 limited, but cumulatively considerable.

1 4. The project, as conditionally approved, does not have environmental effects which
2 will. cause substantial adverse effects on human beings, either directly or indirectly.

4 5. The traffic impact of this five-unit subdivision will be slight, relative to the required
5 improvements and capacity of the existing road network and the impact. of the
6 subdivision will be mitigated through conditions of approval.

8 6. The potential adverse drainage impacts of the project are .adequately mitigated
9 through conditions of approval.

11 7. Conditions of approval and site design adequately mitigate potential adverse
12 impacts on the scenic qualities and plant species of the site.
