HomeMy WebLinkAboutResolution 90-385 11/19/1990ReSOIUtI®n NO. 9o-~s5 N.C.S. of the City of Petaluma, California 1 2 3 4 APPROVING THIRD EXTENSION OF 1989 ALLOTMENTS 5 FOR TWIN CREEKS SUBDIVISION 6 7 WHEREAS, the City of Petaluma has adopted a Residential Growth Management 8 System's Ordinance; and 9 10 WHEREAS, Twin Creeks Subdivision was granted 65 - 1989 allotments pursuant to the 11 Residential Growth Management System Ordinance on June 20th, 1988, at a public 12 meeting by the City Council; and 13 14 WHEREAS, Section 17.26.070(F) of the Residential Growth Management System 15 Ordinance (Chapter 17.26 of the Municipal Code) establishes a deadline of December 31st 16 of the year said allotments are granted for, as the date by which certain projects must have 17 either an approved tentative map or have been through preliminary review and have had 18 their project application deemed complete by the Community Development Department; 19 and 20 21 WHEREAS, Section 17.26.070(G) of the Residential Growth Management System 22 Ordinance requires projects subject to the growth management system to have completed 23 approval of all related documents on or before December 31st of the year for which the 24 allotments have been granted or said allotments shall be forfeited; and 25 26 WHEREAS, with appropriate findings, the City Council may extend the December 31st 27 deadline for projects approval and forfeiture of allotments.; and 28 29 WHEREAS, failing to meet the deadline of December 31, 1989, to have a completed, 30 approved project, Twin Creeks 1989 allotments became subject to forfeiture, pursuant to 31 the Residential Growth Management System; and 32 33 WHEREAS, on December 11, 1989, the Council extended all 65 - 1989 allotments granted 34 to Twin Creeks to June 30, 1990; and on June 18, 1990 extended 50 allotments to 35 December 31, 1990; and 36 37 WHEREAS, on June 4, 1990, the City Council certified the Environmental Impact Report 38 for Twin Creeks, but denied the project due to being inconsistent with the General Plan, Res. No.......9.Q.-.3.85...... N.C.S. 1 1 substantial environmental impacts identified by the EIR and flooding problems identified 2 by the Army Corps of Engineers; and 3 4 WHEREAS, the environmental impact report required an extended amount of time to 5 complete due to the complexity of the project; and 6 7 WHEREAS, the applicant has agreed to redesign the project to address the comments 8 cited above and other comments received at the public hearing; and 9 10 WHEREAS, staff has determined that one year is ample time to complete a Subsequent 11 Environmental Impact Report anal process the application; and 12 13 WHEREAS, the tentative map submitted shows only 43 of the 50 allotments granted will 14 be used by the subdivision; 15 16 NOW, THEREFORE, BE IT RESOLVED that the City Council hereby extends the 17 forfeiture deadline of December 31, 1990 to December 31, 1991 for 43 - 1989 allotments 18 granted to Twin Creeks based on the following findings: 19 1. The project has a certified EIR. 20 2. The project has been redesigned based in an attempt to address issues identified by 21 the EIR anal discussed at the public hearing of June 4, 1990. 22 3. The project has particular characteristics that have made processing more difficult 23 and lengthier than normal. 24 4. Due to the complexity of the project, the EIR took longer than normal to complete. 25 26 27 28 twncrk / gb5 Under the power and authority conferred upon this Council by the Charter of said City.
