2 RESOLUTION APPROVING .ISSUANCE OF' A MITIGATED NEGATIVE
3 DECLARATION PURSUANT TO CEQA FOR THE CREATION OF THE
4 ROSEVIEW SUBDIVISION LOCATED BETWEEN HALSEY AVENUE AND
5 OLIVE STREET, AP N0.008-401-11

7 WHEREAS, the Planning Commission has recommended issuance of a Mitigated Negative
8 Declaration pursuant to the California Environmental Quality Act (CEQA) for a proposal
9 to create afourteen-lot residential subdivision between Halsey Avenue and Olive Street;
10 and,

12 WHEREAS, an initial study which noted potential impacts on traffic and circulation,
13 drainage, noise, historic/archaeological and scenic qualities has been prepared for the
14 project and has been reviewed by the Community Development Department; and
15
16 WHEREAS, the result of this study have indicated that conditional approval of this project
17 will not trigger any significant adverse environmental impacts that cannot be mitigated
18 through conditions of approval; and,
19
20 WHEREAS, staff and the Planning Commission have recommended that a mitigated
21 negative declaration be issued on the above project;

23 NOW, THEREFORE, BE IT RESOLVED that the issuance of said Mitigated Negative
24 Declaration pursuant to the California Environmental Quality Act is hereby approved,
25 based upon the following findings:

27 1. The project, as conditionally approved, does not have the potential to degrade the
28 quality of the environment, substantially reduce the habitat of a fish or wildlife
29 species, cause a fish or wildlife population to drop below self-sustaining levels,
30 threaten to eliminate a plant or animal community, reduce the number or restrict
31 the range of a rare or endangered plant or animal or eliminate important examples
32 of the major periods of California history or prehistory.

34 2. The project, as conditionally approved, does not have the potential to achieve short-
35 term, to the disadvantage of long-term, environmental goals.

37 3. The project, as conditionally approved, does not have impacts which are individually
38 limited, but cumulatively considerable.

2 4. The project, as conditionally approved, does not have environmental effects which
3 will cause substantial adverse effects on human beings, either directly or indirectly.

5 5. Potential adverse impacts related to traffic, circulation, drainage, noise, scenic, and
6 historical/archaeological features are mitigated through project design and/or
7 conditions of approval.
