HomeMy WebLinkAboutResolution 90-392 11/26/1990.~ ReSOIUtI®~ Nom. 90-392 N C.~. 1 of the City of Petaluma, California 2 RESOLUTION AMENDING GENERAL PLAN BY INCORPORATING 3 SONOMA COUNTY'S HAZARDOUS WASTE MANAGEMENT PLAN 4 5 6 WHEREAS, on October 16, 1989, the City Council approved the Sonoma County 7 Hazardous Waste Management Plan; and 8 9 WHEREAS, the County and City Council requested that this matter be incorporated in the 10 Petaluma General Plan by reference; and 11 12 WHEREAS, the Petaluma City Planning Commission has reviewed this proposal and has 13 held public hearings thereon, and after said hearings has made recommendations on said 14 amendments; and, 15 16 WHEREAS, the Planning Commission filed with the City Clerk its report as set forth in its 17 minutes of October 9 and 23, 1989 (File 8.120), recommending adoption of said proposed 18 amendment; and 19 20 WHEREAS, the City Council held a public hearing on the proposed amendments on 21 November 19, 1990, as stated below; and 22 23 NOW, THEREFORE, BE IT RESOLVED that the City Council hereby .makes the 24 following findings: 25 26 Findings: 27 1. The proposed amendment is deemed to be in the public interest. 28 29 2. The proposed General Plan amendment is consistent and compatible with the rest 30 of the General Plan and any implementation programs that may be affected. 31 32 3. The potential impacts of the proposed amendment have been assessed and have 33 been determined not to be detrimental to the public health, safety, or welfare. 34 35 4. The proposed amendment has been processed in accordance with the applicable 36 provisions of the California Government Code and the California Environmental 37 Quality Act (CEQA). Res. N.C.S. 1 1 2 NOW, THEREFORE, BE IT FURTHER RESOLVED that the following addition is 3 made to Petaluma General Plan, Community Health and Safety Chapter: 4 5 11.8 Hazardous Waste Management 6 7 The need to develop a rational planned approach to long term hazardous waste 8 management became increasingly evident during the 1980's. Partly in response 9 to this need, Assembly Bill (AB) 2948, sponsored by Tanner and passed in 1986, 10 gave California counties the opportunity to prepare county hazardous waste 11 management plans and provided funds to be allocated to the counties for plan 12 preparation. In Sonoma County, the County Public Health Officer, the 13 Hazardous Materials Management Commission, and the staff of the County 14 Department of Public Health prepared a plan. Tltis plan was approved by the 15 City Council in October, 1989. 16 17 The plan addresses hazardous wastes as defined in the State Department of 18 Health Services guidelines for plan preparation. Simply stated, the plan 19 addresses wastes which pose a threat to human health or the environment by 20 being ignitable, corrosive, reactive, or toxic; radioactive and infectious wastes are 21 not considered. The plan is based on one goal. The goal of the plan is to 22 provide protection for the public health, safety, welfare, and the environment by 23 establishing a framework for the responsible management of hazardous wastes 24 while maintaining economic vitality. The Plan contains a permitting process 25 and criteria for evaluating potential sites for hazardous waste facilities, as well as 26 facility and performance review requirements for particular projects, if and when 27 proposed. 28 29 Objective (1): Establish Sonoma Countys Hazardous Waste Management Plan 30 as the method to minimize the danger to Petaluma's citizens from the transport, 31 treatment and storage of hazardous waste. 32 33 34 2 1 Policy 24: The City of Petaluma shall use Sonoma County's Hazardous Waste 2 Management Plan when addressing how to handle waste that poses a threat to 3 human health or the environment by being ignitable, corrosive, reactive, or toxic. 4 5 Program (21): In order to minimize the dangers of hazardous waste, the City 6 shall require the handling transport, treatment, storage or disposal of such waste 7 in a manner that is consistent with Sonoma County s Hazardous Waste 8 Management Plan. 9 ... , 10 11 12 13 hazmat/council-4 Under the power and authority conferred upon this Council by the Charter of said City.
